1.                  Call Meeting To Order

 

Chair Dennis Kussmann called the meeting to order at 9:02 a.m. 

 

2.                  Roll Call

 

Shoreland Zoning Advisory Committee Members Present:  Chris Klein (Little Hope Millpond/Town of Dayton), Kay Ellis (Chain O’Lakes Property Owners Association), Richard Mann (Lake Leader Representative), TJ Tooley (Pigeon Lake), Bob Van Epps (Lake Leader Representative/Weyauwega Lake), Dennis Kussmann (County Board/Planning & Zoning Committee), John Penney (County Board/Planning & Zoning Committee), Bob Ellis (County Board/Planning & Zoning Committee), David Johnson (County Board/Board of Adjustment/Waupaca River), John Skyrms (Old Taylor Lake Association), Bob Underberg (Chain O’Lakes Property Owners Association), James Loughrin (County Board/Board of Adjustment), Terry Murphy (Iola Lake District/County Board/Planning & Zoning Committee), G. Shoreland Zoning Advisory Committee Members Excused:  Kent Gibbs (Stratton Lake Association President), Joe Udoni (Realtor), Terry Martin (Architect) and Tom O’Day (Waupaca & Wolf River).

 

Staff Present:  Ryan Brown, Jean Gliniecki, Jeff Henneman and Jason Snyder.

 

3.                  Chair Kussmann read the Open Meeting Statement, “This meeting and all other meetings of this committee are open to the public.  Proper notice has been posted and given to the press in accordance with Wisconsin Statutes, so the citizenry may be aware of the time, place and agenda of this meeting.”

 

4.                  Approve Agenda As Presented

 

TJ Tooley motioned to approve the agenda as presented.  The motion was seconded by John Skyrms.  Motion carried unanimously. 

 

5.                  Approve and Sign Minutes from the May 22, 2013 meetings. 

 

John Skyrms motioned to approve the minutes as amended below.  The motion was seconded by TJ Tooley.  The motion was carried.

 

Chris Klein motioned to approve the changes to Sec. 5.58 to change “and” to “and/or”, strike the “s” on corridors and change “shall” to “should”.  The motion was seconded by Robert Van Epps. 

 

 

5.58 View Corridor

 

Establishment of a single view corridor on each lot containing a principal structure by selective pruning and removal of trees and shrubbery may be created by tThe removal of trees and shrubs “and/or” selective pruning in the vegetation protection area to create a single access and viewing corridors, provided that the combined width of all access and viewing corridors on a riparian lot or parcel may not exceed the lesser of 30 percent of the shoreline frontage or 200 100 feet. Clear cutting, filling, grading and other land disturbing activities are not permitted.  Sufficient trees and shrubbery shall should be retained to screen development from view from the water.

 

A vote was taken on the above changes with 7 yes votes and 7 no votes, motion failed.

 

Bob Van Epps motioned to amend Sec. 5.58 as stated below.  The motion was seconded by Bob Underberg. 

 

5.58 View and Access Corridor

 

Establishment of a single view and access corridor(s)  on each lot containing a principal structure by selective pruning and removal of trees and shrubbery may be created by tThe removal of trees and shrubs and selective pruning in the vegetation protection area to create a single viewing and access corridors, provided that the combined width of all the access and viewing corridor(s) on a riparian lot or parcel may not exceed the lesser of 30 percent of the shoreline frontage or 200 100 feet.  Sufficient trees and shrubbery shall be retained to screen development from view from the water.  Clear cutting, filling, grading and other land disturbing activities are not permitted on trout streams listed in the most current Wisconsin Department of Natural Resources Publication Wisconsin Trout Streams.

 

A vote was taken on the above changes with 12 yes votes and 1 no vote, motion carried.

 

TJ Tooley motioned to amend Sec. 5.58 to put an “s” on each access and corridor.  The motion was seconded by Bob Ellis.  A vote was taken 14 yes votes and 0 no votes, motion carried.

 

The Committee discussed adding the word “Required” to Sec. 8.33(2) as follows:  “Expansion of a Nonconforming Principal Structure Beyond Required Setback.

 

6.                  The Committee continued their review of the proposed amendments to the Waupaca County Shoreland Zoning Ordinance.   

 

Planning and Zoning Office Staff reviewed the Impervious Surface Brochure published by UW-Extension and DNR 2012.

 

 “6.2  Impervious Surface Standards” was tabled to see whether or not impervious could be eliminated from the ordinance.  Jeff Henneman talked to Heidi Kennedy regarding the impervious surface being eliminated from the Shoreland Zoning Ordinance.  Mrs. Kennedy said the DNR did not have a problem as long as the meaning is the same.    She stated that Walworth County used the word Open Space.

 

Bob Underberg motioned to table Sec. 6.2 to go back to staff.  The motion was seconded by Caroline Murphy.  The motion was carried.

 

7.11  Locating Shoreland‑Wetland Boundaries. 

Where an apparent discrepancy exists between the shoreland‑wetland district boundary shown on the Wisconsin Wetland Inventory maps and actual field conditions, the county shall contact the Department to determine if the map is in error  at the time the maps were adopted, the Zoning Administrator shall contact the appropriate district office of the Department to determine if the shoreland‑wetland district boundary as mapped is in error.  If the Department determines staff concur with the Zoning Administrator that a particular area was incorrectly mapped as a wetland, or meets the wetland definition but was not shown as a wetland on the map, the Zoning Administrator county shall have the authority to immediately grant or deny a shoreland zoning permit in accordance with the applicable regulations based on the Department determination as to whether “or not” the area is a wetland.  applicable to the correct zoning district.  The Zoning Administrator shall initiate a map amendment to correct any mapping errorsIn order to correct wetland mapping errors on the official zoning map, an official zoning map amendment must be initiated within a reasonable period of time.

 

The Committee decided to add “or not” to the above sentence in Sec. 7.11.

 

The Committee decided to write out the words for numbers as well as putting the number in, such as in Sec. 7.153 when it states thirty (30) days.

 

Numerous housekeeping issues throughout the ordinance, such as using “Planning and Zoning Director” and “Planning and Zoning Committee”.

 

Bob Underberg motioned to approve from Sec. 7.1 through Sec. 7.153.  The motion was seconded by Bob Ellis.  The motion was carried.

 

7.                  Public Comment.  There was none.

 

The next meeting date for the Shoreland Zoning Advisory Committee will be Wednesday, July 24, 2013 at 9:00 a.m. in Room 1068 (County Board Room) at the Courthouse and the Committee will start with Sec. 7.2 Group 1 Lakes.

 

8.                  Adjourn

 

At 11:03 a.m., Bob Underberg motioned to adjourn the meeting.  The motion was seconded by Bob Van Epps.  Motion carried unanimously.
