OPEN SESSION

 

1.                  Call Meeting To Order

 

Chair Dennis Kussmann called the meeting to order at 2:05 p.m. 

 

2.                  Roll Call

 

Shoreland Zoning Advisory Committee Members Present:  Bob Underberg (Chain O’Lakes Property Owners Association), Terry Martin (Architect), Joe Udoni (Realtor), Chris Klein (Little Hope Millpond/Town of Dayton), Bruce Golding (Little Hope Millpond/Town of Dayton), Kay Ellis (Chain O’Lakes Property Owners Association) , Richard Mann (Lake Leader Representative), Tom O’Day (Waupaca & Wolf River), TJ Tooley (Pigeon Lake), Bob Van Epps (Lake Leader Representative/Weyauwega Lake), Terry Murphy (Iola Lake District/County Board/Planning & Zoning Committee), Dennis Kussmann (County Board/Planning & Zoning Committee), John Penney (County Board/Planning & Zoning Committee) and Bob Ellis (County Board/Planning & Zoning Committee).

 

Staff Present:  Ryan Brown, Jean Gliniecki, Jeff Henneman and Jason Snyder.

 

3.                  Chair Kussmann read the Open Meeting Statement, “This meeting and all other meetings of this committee are open to the public.  Proper notice has been posted and given to the press in accordance with Wisconsin Statutes, so the citizenry may be aware of the time, place and agenda of this meeting.”

 

4.                  Approve Agenda As Presented

 

John Penney motioned to approve the agenda as presented.  The motion was seconded by Terry Murphy.  Motion carried unanimously. 

 

There was an introduction to the Shoreland Zoning Advisory Committee and Planning & Zoning Office staff.

 

It was decided that future meeting dates would be on Tuesday, February 26; Tuesday, March 12 and Tuesday, March 26 from 2:00 p.m. until approximately 4:00 p.m. in Room Lower Level 42.

 

Jeff Henneman gave an over view of the history of the Shoreland Zoning Ordinance and the changes that have been made.   The current changes being made to the Shoreland Zoning Ordinance were changes made to NR115 (Wisconsin’s Shoreland Protection Program) and Act 170 (2011 Senate Bill 472, dealing with nonconforming structures).

 

5.                  The Committee reviewed a few of the proposed amendments to the Waupaca County Shoreland Zoning Ordinance.

 

Planning & Zoning Staff went over the summary sheet of important topics.  The Advisory Committee agreed that in Section 5.55 the word patios need to be removed because this was addressed in the impervious surface standards.

 

5.55 Leveling Existing Brick Walkways or Patios

A landowner may level an existing brick or block walkway or patio within the vegetation protection area.  However, provided that the dimensions of the walkway or patio are not cannot be expanded, it is located in the same footprint as the existing patio/walkway and the same material is utilized after leveling.  The property owner shall submit a photo of the site and inform the Planning and Zoning Department Office of the date of proposed reconstruction prior to commencing work.

 

The Committee discussed view corridor. 

 

5.58 View CorridorEstablishment of a single view corridor on each lot containing a principal structure by selective pruning and removal of trees and shrubbery.  The removal of trees and shrubs in the vegetation protection area to create a single access and viewing corridors, provided that the combined width of all access and viewing corridors on a riparian lot or parcel may not exceed the lesser of 30 percent of the shoreline frontage or 200 feet.  Clear cutting, filling, grading and other land disturbing activities are not permitted.  Sufficient trees and shrubbery shall be retained to screen development from view from the water The corridor shall be no more than 30 feet wide in the dimension paralleling the shore.

 

The Committee decided to leave this sentence in this section:  “Establishment of a single view corridor on each lot containing a principal structure by selective pruning and removal of trees and shrubbery.”  But to strike this portion of the paragraph “The removal of trees and shrubs in the vegetation protection area to create a single access and viewing corridors,

 

The Committee was not in favor of a view corridor being 200 feet wide because they felt that was too wide and they thought on the smaller lots it should be wider than 30 % of the width.   A recommendation was made as follows:

 

Ø  Lots less than 100 feet – maximum of 30 foot corridor  (Could be mitigated)

Ø  Lots greater than 100 feet – maximum of 50 foot corridor   (Could be mitigated)

                       

The Committee also discussed impervious surface standards and mitigation.

 

A recommendation was made in order to make better use of office time, to have the landowner provide annual photographs of the mitigation site from the water.  The office would then only visit the sites that were questionable.

 

The next meeting date will be Tuesday, February 26, 2013 at 2:00 p.m. in Room Lower Level 42 at the Courthouse.
