WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –MARCH 9, 2015

 

Chm. Penney called the meeting to order at: 9:00 a.m. with the following members present:  J. Penney, D. Kussmann, W. Wilfuer and D. Federwitz, present.  Terry Murphy was excused.

 

D. Federwitz moved and W. Wilfuer seconded the motion to amend the agenda for Public Comment to follow the Discussion & Possible Action of the Creation of Chapter 38, Waupaca County Draft Non-Metallic Mining Ordinance, Waupaca County Code of Ordinances.   The motion was carried.

 

Ryan Brown, Planning & Zoning Director, said the Attorney advised to extend the moratorium in order to review the procedural changes.  Mr. Brown explained the process for the resolution for the extension to be presented to the Planning & Zoning Committee; Legislative, Judicial, Ethics, Safety & Security Committee and the County Board for approval.

 

Public Comment:

 

Patricia Craig asked if it was appropriate for the Planning & Zoning Committee to act on the resolution for the extension of the moratorium since it was not listed on the agenda.

 

Ryan Brown, Planning & Zoning Director, said the Attorney said that because it is still in relation to the Draft Non-Metallic Ordinance that it is legal.

 

Patricia Craig commended the Planning & Zoning Committee for responding to the citizen’s recommendations.  Ms. Craig suggested that the Planning & Zoning Committee review the procedural changes.

 

Deanna Hannigen said she doesn’t understand the language for the timing of the extension of the moratorium.

 

Ryan Brown, Planning & Zoning Director, explained the extension of the moratorium time frame as it coincides with the County Board meeting.

 

Jane Haasch asked if other points would be considered like distance from an active mine and property value or just procedural changes during the moratorium time.

 

Ryan Brown, Planning & Zoning Director, said just the procedural changes, proper language and legalities of the Draft Non-Metallic Mining Ordinance would be considered.

 

Marcy Wentworth said she is concerned with the Conditional Use Permit application for the Draft Non-Metallic Ordinance and suggested a comprehensive list for the Planning & Zoning Committee.

 

Tanya Wadzinski questioned the Attorney’s time frame to review the procedural changes and time frame allowed for her Attorney and the public to also review the Draft Non-Metallic Ordinance. 

 

Ryan Brown, Planning & Zoning Director, said the Attorney is reviewing the procedural changes of the Draft Non-Metallic Ordinance and it should be available this week. 

 

Kay Ellis said she is confused by the procedural changes and if the suggestions and concerns from the public hearings will be considered.  Ms. Ellis asked the Attorney’s name.

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – MARCH 9, 2015

 

Ryan Brown, Planning & Zoning Director, said some changes were made and some changes are not going to be made and the Planning & Zoning Committee has the option for discussion.  Mr. Brown said the Attorney is Andy Phillips.

 

Kay Hamilton said if there are areas that need to be changed what is the procedure to make the changes.

 

Ryan Brown, Planning & Zoning Director, said if changes need to be made they will be brought back to the Planning & Zoning Committee.

 

Brad Millikins said he was not able to make all of the hearings and is concerned with the financial impact of property values.

 

Robert Ellis said he does not feel that the extension is enough time for review.

 

Carol Peterson said she attended the meetings and feels there is no protection for the property owners and she also felt that issues were not addressed.

 

Chm. Penney said that he gave every opportunity for the public to be heard and felt that the issues were addressed and if necessary, the Planning & Zoning Committee will make changes.

 

Ryan Brown, Planning & Zoning Director, explained the time frame of the extension as it coincides with the County Board meeting and that the current moratorium expires March 24, 2015.  Mr. Brown said that the Attorney is going to review the Draft Non-Metallic Ordinance.  Mr. Brown explained that the Planning & Zoning Department throughout the course of the year goes through the Ordinances and makes revisions if needed, unless it is a time sensitive matter.

 

Ramona Danke said she lives in a subdivision and is outside of the 1,320 foot parameter and feels the whole subdivision should be included.  Ms. Danke said she is also concerned that the water and property values will be impacted.

 

Tanya Wadzinski said she feels that certain terms in the Draft Non-Metallic Ordinance should be strengthened like may versus should.

 

D. Kussmann moved and W. Wilfuer seconded the motion to EXTEND the moratorium until the May 19, 2015 meeting of the County Board.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes and D. Federwitz—yes, unanimous vote to extend the moratorium.  The motion was carried.

 

The next Planning and Zoning Committee meeting has been scheduled for Thursday, March 19, 2015.

D. Federwitz moved and W. Wilfuer seconded the motion to adjourn the meeting at 10:00 a.m.  The motion was carried.
