MINUTES –NOVEMBER 20, 2014

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Melissa L. Buelow property, Town of Lebanon and the Randy G. & Veronica L. Johnson property, Town of Royalton.

 

Chm. Penney called the meeting to order at: 9:30 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.

 

 D. Federwitz moved and W. Wilfuer seconded the motion to approve the agenda as presented.  The motion was carried.

 

D. Kussmann moved and T. Murphy seconded the motion to approve the minutes from the October 9, 2014 meeting.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:32 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Melissa L. Buelow:  Located in part of the NW ¼ of the SW ¼ of Sec. 12, Town of Lebanon, lying along Buelow Road, Fire Number N6682, Waupaca County, Wisconsin; for a Conditional Use Permit application for the replacement of a structure to be used for human habitation that doesn't meet the 22 foot minimum width requirement in an RR (Rural Residential) District on approximately 2.01 acres.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Melissa Buelow was sworn in to testify.  Ms. Buelow said she would like to replace the existing mobile home with a newer, larger, mobile home which requires a Conditional Use Permit.  Ms. Buelow said North Country Homes will remove the existing mobile home when the new one is placed.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

Deb Giuffre read one (1) letter from the Town of Lebanon recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request and recommended approval with proper permits.

 

D. Federwitz moved and W. Wilfuer seconded the motion to GRANT the application for Conditional Use Permit due to the following:  The Town Board of Lebanon recommended approval of this permit and it is consistent with the Town Comprehensive Plan. The following conditions MUST be met:  The applicant must have the existing sanitary system evaluated to make sure that it is functioning properly.  The applicant

must obtain a Land Use Permit from the Planning & Zoning Office prior to the placement of the structure on the property.  The applicant must check with the local Building Inspector to see if a Building Permit is necessary prior to the placement of the structure on the property.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and W. Wilfuer seconded the motion to close the hearing at 9:40 a.m.  The motion was carried.

The second public hearing was called to order at 9:41 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Randy G. & Veronica L. Johnson:  Located in part of the SW ¼ of the SE ¼ of Sec. 29, Town of Royalton, lying along Butternut Ridge Road, Fire Number E5542, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Contractor Shop (asphalt business) in an AWT (Agriculture and Woodland Transition) District on approximately 17 acres.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Rodney Johnson was sworn in to testify.  Mr. Johnson said he is the agent and his brother is the owner of the property.  Mr. Johnson said he is currently using the existing shop for an asphalt business and was not aware that he needed a Conditional Use Permit. Mr. Johnson said the shop does not have any plumbing facilities. Mr. Johnson said he currently has eight (8) employees including himself.

Deb Giuffre read one (1) letter from the Town of Royalton recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request and recommended approval with conditions.  Ms. Gliniecki explained the requirements if the property owner would ever have plumbing in the structure.

 

T. Murphy moved and W. Wilfuer seconded the motion to GRANT the application for Conditional Use Permit due to the following:  The Town of Royalton Planning Commission and the Town Board of Royalton recommended approval of this permit and it is consistent with the Town Comprehensive Plan.  The following conditions MUST be met:  If there will ever be plumbing in the building, there must be a code complying sanitary system installed for it. Required parking is one (1) parking space per each employee on the largest work shift. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and D. Federwitz seconded the motion to close the hearing at 9:48 a.m.  The motion was carried.

REVIEW:

 

Rose L. Weed, Conditional Use Permit (CP-015-13) in Sec. 9, Town of St. Lawrence for a structure to be used for human habitation that doesn't meet the 22 foot minimum width requirement in an AR (Agriculture Retention) District on approximately 8.75 acres.  The Committee reviewed the following condition:  “There shall be a one (1) year review of this permit to make sure that the access will comply with the Town’s driveway/access ordinance that they will be adopting.”

 

At the request of the applicant and with the Town of St. Lawrence agreeing with it, D. Kussmann moved and T. Murphy seconded the motion to extend the review to be held by August 1, 2015.  The motion was carried.
