MINUTES – OCTOBER 9, 2014

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the George P. & Judith A. Kunnanz property, Town of Matteson; the Sharel L. Flanagan property, Town of Little Wolf; the David C. & Jon C. Seitz property, Town of Iola and the John D. & Patricia L. Huebner property, Town of Farmington. 

 

Chm. Penney called the meeting to order at: 10:45 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.

 

 D. Kussmann moved and T. Murphy seconded the motion to approve the agenda as presented.  The motion was carried.

 

D. Federwitz moved and W. Wilfuer seconded the motion to approve the minutes from the July 31 and August 26, 2014 meetings.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 10:46 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  One of the proposed amendments is to the Comprehensive Plan Preferred Land Use Map within the Town of Matteson.  This map amendment is to accommodate Town preferred land use desires and to ensure that the Waupaca County Comprehensive Plan remains consistent with the locally adopted comprehensive plans.  The second amendment is to adopt the Waupaca County Farmland Preservation Plan as Appendix C and to adopt the Inventory and Trends Report as Appendix D.

 

Ryan Brown, Planning & Zoning Director, explained that the amendment to adopt the Waupaca County Farmland Preservation Plan as Appendix C and to adopt the Inventory and Trends Report as Appendix D is to be postponed until the October 30, 2014 Planning and Zoning Committee meeting.  Mr. Brown said that Waupaca County has not received certification from the Department of Agriculture Trade Consumer Protection (DATCP). 

 

Ryan Brown, Planning & Zoning Director, explained the proposed amendment to the Comprehensive Plan Preferred Land Use Map within the Town of Matteson.

 

T. Murphy moved and D. Federwitz seconded the motion to APPROVE the Comprehensive Plan Amendment for the Town of Matteson.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to approve the Comprehensive Plan Amendment.  T. Murphy moved and W. Wilfuer seconded the motion to close the hearing at 10:50 a.m.  The motion was carried.

Chm. Penney said the fourth public hearing scheduled for Tammy A. Bucholtz will be postponed due to the Committee not having access to the property.

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES –

OCTOBER 9, 2014

 

D. Federwitz moved and W. Wilfuer seconded the motion to POSTPONE the application for Conditional Use Permit due to the following:  The Committee was unable to view the site during their on-site inspections due to a locked gate at the entrance. The Committee decided to continue this public hearing at their next regularly scheduled meeting on October 30, 2014.  An on-site inspection will also be made on the property that day.  The motion was carried.

 

Tammy Bucholtz said she had spoke with the Planning and Zoning Office and was told to attend the meeting and now it’s being postponed.

 

Ryan Brown, Planning & Zoning Director, said she is required to attend the public hearing as the property owner for the proposed Conditional Use Permit.  Mr. Brown said the Committee decided to postpone the public hearing until October 30, 2014 because they did not have access to view the site.

The second public hearing was called to order at 10:53 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for George P. & Judith A. Kunnanz:  Located in part of the SE ¼ of the SE ¼ of Sec. 30, Town of Matteson, lying along County Highway I, Fire Number E10046, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an AR (Agriculture Retention) to a RR (Rural Residential) for the creation of two (2) parcels and an additional development right for residential development on approximately 4.998 acres.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  T. Murphy read the general procedure and Chm. Penney declared it a legal hearing.

 

George Kunnanz was sworn in to testify.  Mr. Kunnanz said he would like to build a home on the new parcel.

 

Ryan Brown, Planning & Zoning Director, said to create a development right for a dwelling for the proposed land division, requires a Petition for Zoning Map Amendment.   

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

Deb Giuffre read two (2) letters, one (1) from the Town of Matteson recommending approval of the application and one (1) from the County Highway Department with recommendations.

 

11:00 a.m. – D. Kussmann was excused.

 

D. Federwitz moved and W. Wilfuer seconded the motion to GRANT the application for Petition for Zoning Map Amendment due to the following: The Town of Matteson Planning Commission and the Town Board of Matteson have recommended approval of this request and it is consistent with the Town’s Comprehensive Plan.   Roll call vote was taken:  J. Penney—yes; W. Wilfuer—yes; D. Federwitz—yes

and T. Murphy—yes, unanimous vote to grant the zone change.  T. Murphy moved and W. Wilfuer seconded the motion to close the hearing at 11:02 a.m.  The motion was carried.

The third public hearing was called to order at 11:03 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, T. Murphy, W. Wilfuer and D. Federwitz, present. D. Kussmann was excused.  Deb Giuffre read the names of persons notified of the hearing for Sharel L. Flanagan:  Located on 1 acre in the Northeast corner of the SE ¼ of the SE ¼ of Sec. 2, Town of Little Wolf, lying along County Highway O, Fire Number N6997, Waupaca County, Wisconsin; for an after the fact Conditional Use Permit application for a Commercial Animal Facility (dog breeding) in an AE (Agriculture Enterprise) District on approximately 1 acre.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  T. Murphy read the general procedure and Chm. Penney declared it a legal hearing.

 

Sharel Flanagan was sworn in to testify.  Ms. Flanagan said she has a dog breeding business and was notified from the Planning and Zoning office that it required a Conditional Use Permit.  Ms. Flanagan said she has been breeding dogs for fifteen (15) years and would like to have a maximum of fourteen (14) adult dogs.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

Jackie Beyer was sworn in to testify.  Ms. Beyer said she is the Planning Commission Chairman and the Clerk for the Town of Little Wolf and the Township recommends approval with conditions.   Ms. Beyer explained the dog licensing and kennel licensing permit process and the need for ordinance revisions.

 

Deb Giuffre read two (2) letters, one (1) from the Town of Little Wolf recommending approval of the application with conditions and one (1) from the County Highway Department with recommendations.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request and recommended approval with the conditions recommended by the Town of Little Wolf.

 

T. Murphy moved and W. Wilfuer seconded the motion to GRANT the application for Conditional Use Permit due to the following:  The Town of Little Wolf Planning Commission and the Town Board of Little Wolf recommended approval of this Conditional Use Permit.  The following conditions MUST be met:  The Committee is limiting the applicant to a maximum of fourteen (14) adult dogs being included in this dog breeding business at any one time. The property owner shall allow the constable to do random welfare and compliance inspections. This permit shall expire with the Flanagan’s ownership of the property.  Roll call vote was taken:  J. Penney—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  T. Murphy moved and D. Federwitz seconded the motion to close the hearing at 11:23 a.m.  The motion was carried.

 The fifth public hearing was called to order at 11:24 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, T. Murphy, W. Wilfuer and D. Federwitz, present. D. Kussmann was excused.  Deb Giuffre read the names of persons notified of the hearing for David C. & Jon C. Seitz:  Located in part of the SE ¼ of the NW ¼ of Sec. 3, Town of Iola, lying at the end of Forest Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for the placement of a recreational vehicle intended for temporary living purposes in excess of 30 days in an PVRF (Private Recreation and Forestry) District on approximately 39 acres.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean

Gliniecki, Zoning Administrator, made an on-site inspection of the property.  T. Murphy read the general procedure and Chm. Penney declared it a legal hearing.

 

David Seitz was sworn in to testify.  Mr. Seitz said he has a recreational vehicle on a concrete slab on the property that is used for family hunting and occasional recreational use in the summer. Mr. Seitz said the property has running water, electricity and septic will be installed in the future.

 

DuWayne Federwitz, Planning & Zoning Committee member asked about the permit requirements for a concrete slab.

 

Ryan Brown, Planning & Zoning Director, explained that concrete slabs/patios are considered structures and require a Land Use Permit.

Deb Giuffre read one (1) letter from the Town of Iola recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request and recommends approval with conditions.

 

W. Wilfuer moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit due to the following: The Town Board of Iola has recommended approval of this permit and it is consistent with the Town Comprehensive Plan.  The following conditions MUST be met:  Must obtain a fire number for this property.  Must have a County approved sanitary system on the property.  Must obtain a Land Use Permit from the Planning & Zoning Office for the existing patio on the property.  (This is an After the Fact permit so the fee will be doubled and is $150.)  Roll call vote was taken:  J. Penney—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  T. Murphy moved and D. Federwitz seconded the motion to close the hearing at 11:33 a.m.  The motion was carried.

The sixth public hearing was called to order at 11:34 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, T. Murphy, W. Wilfuer and D. Federwitz, present. D. Kussmann was excused.   Deb Giuffre read the names of persons notified of the hearing for John D. & Patricia L. Huebner:  Located in part of the North ½ of the NE ¼ of the SW ¼ and also part of the NW ¼ of the SW ¼ of Sec. 36, Town of Farmington, lying along King Road, Fire Number E2223, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Outdoor Institutional (outdoor education and interpretive center) in an SR-20 (Sewered Residential Single-Family) District on approximately 5.85 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Lori Hontoon was sworn in to testify.  Ms. Hontoon said she is the agent for John and Patricia Huebner and she plans on purchasing the properties from the Huebner’s and establishing an outdoor education and interpretive water center.  Ms. Hontoon said she would like to affiliate with school districts and colleges. The outdoor education and interpretive water center will employ two (2) full-time and three (3) to four (4) part-time employees.

Deb Giuffre read two (2) letters, one (1) from the Town of Farmington recommending approval of the application and one (1) from the property owner verifying the proposed purchase of the properties.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request and recommends approval with conditions.

 

D. Federwitz moved and W. Wilfuer seconded the motion to GRANT the application for Conditional Use Permit due to the following: The Town of Farmington Planning Commission and the Town Board of Farmington have recommended approval of this permit and it is consistent with the Town Comprehensive Plan.  The following conditions MUST be met:  The applicant will be required to have the existing sanitary system evaluated due to the change in use of the structure.  Prior to any remodeling or repairs to the existing structure, the applicant must check to see if a Land Use Permit is required from the Planning & Zoning Office or if a Building Permit is required from the local Building Inspector. Required parking includes one (1) parking space per three (3) expected patrons at maximum capacity.   Roll call vote was taken:  J. Penney—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Federwitz moved and W. Wilfuer seconded the motion to close the hearing at 11:47 a.m.  The motion was carried.

 

REVIEW

 

Rose L. Weed, Conditional Use Permit (CP-015-13) in Sec. 9, Town of St. Lawrence for a structure to be used for human habitation that doesn't meet the 22 foot minimum width requirement in an AR (Agriculture Retention) District on approximately 8.75 acres. The Planning and Zoning Office will be scheduling a review of the permit to be held at the next regularly scheduled Planning & Zoning Committee meeting after the Town Board of St. Lawrence meets on November 3, 2014 to allow for the Town of St. Lawrence to review the compliance of the driveway/access ordinance.  

 

The next Planning and Zoning Committee meeting has been scheduled for Thursday, October 30, 2014.
