WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –SEPTEMBER 11, 2014

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Bradley M. Sr. & Stacy Peterson property, Town of Iola; the Gary E. & Judy K. Schmidt property, Town of Iola; the Gary K. & Loretta M. Roehrborn property, Town of Caledonia; and the James E. Busse Jr., property, Town of Weyauwega.                                 

 

Chm. Penney called the meeting to order at: 10:32 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.

 

D. Federwitz moved and D. Kussmann seconded the motion to approve the agenda as presented.  The motion was carried.

 

Public Comment: There was none.

 

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 10:36 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Bradley M. Sr. & Stacy Peterson:  Located in part of the SW ¼ of the SW ¼ of Sec. 2, Town of Iola, lying along North Lake Road, Fire Number E1732, Waupaca County, Wisconsin; for an after the fact Conditional Use Permit application for the placement of a recreational vehicle intended for temporary living purposes in excess of 30 days in an AWT (Agriculture and Woodland Transition) District on approximately 20 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Bradley Peterson was sworn in to testify.  Mr. Peterson said he uses the recreational vehicle for hunting and recreational use.  Mr. Peterson said he was contacted by the Planning and Zoning Office regarding the Conditional Use Permit application requirement and that he was unaware that a permit was needed. 

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of Iola recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request and recommended approval with the proper permits.

 

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit due to the following: The Town of Iola Planning Commission and the Town Board of Iola have both recommended approval of this permit and it is consistent with the Town Comprehensive Plan.  The following conditions MUST be met:  The applicant MUST have a County approved sanitary system on

the property.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and D. Federwitz seconded the motion to close the hearing at 10:47 a.m.  The motion was carried.

The second public hearing was called to order at 10:48 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Gary E. & Judy K. Schmidt:  Located in part of the NW ¼ of the NW ¼ of Sec. 17, Town of Iola, lying off of Highway 49, Waupaca County, Wisconsin; for a Conditional Use Permit application for the placement of three (3) recreational vehicles intended for temporary living purposes in excess of 30 days in an PVRF (Private Recreation and Forestry) District on approximately 40 acres.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Gary and Judy Schmidt were sworn in to testify.  Mrs. Schmidt said she was made aware of the need for a Conditional Use Permit for the recreational vehicles while applying for a Land Use Permit.

 

Gary Schmidt said the recreational vehicles have been there since 1983 and are used for hunting and family camping.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

The third public hearing was called to order at 10:56 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Gary K. & Loretta M. Roehrborn:  Located in part of the NE ¼ of the NW ¼ of Sec. 22, Town of Caledonia, lying at the end of

Pine Valley Lane, Fire Number E8654, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an RR (Rural Residential) District to an AWT (Agriculture and Woodland Transition)

District to accommodate a sale/exchange between two adjoining parcels making them both the same zoning district on approximately 8 acres.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

The applicant or representative did not appear for the hearing.  

 

D. Kussmann moved and T. Murphy seconded the motion to POSTPONE the application for Conditional Use Permit until after the next scheduled public hearing due to the fact that no one was present to testify on behalf of the application.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to postpone the public hearing.  The motion was carried at 11:02 a.m.

The fourth public hearing was called to order at 11:03 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for James E. Busse, Jr:  Located in part of the NE ¼ of the NE ¼ of Sec. 18, Town of Weyauwega, lying along Buchholtz Road, Fire Number N1691, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an AWT (Agriculture and Woodland Transition) District to an AR (Agriculture Retention) District to accommodate a sale/exchange between two adjoining parcels making them both the same zoning district on approximately 6.20 acres.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

James Buss, Jr. was sworn in to testify.  Mr. Busse said he would like to exchange some adjoining land which requires a Petition for Zoning Map Amendment to make both parcels zoned the same.

 

Ryan Brown, Planning & Zoning Director, explained the Petition for Zoning Map Amendment requirement of land with two (2) different zoning classifications needing to be zoned the same in order to be consistent with the Town’s Comprehensive Plan.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none.

Deb Giuffre read one (1) letter from the Town of Weyauwega recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Petition for Zoning Map Amendment application request and recommended approval.

 

D. Federwitz moved and W. Wilfuer seconded the motion to GRANT the application for Petition for Zoning Map Amendment due to the following: The Town of Weyauwega Planning Commission and the WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – SEPTEMBER 11, 2014

 

Town Board of Weyauwega have both recommended approval of this request and it is consistent with the Town’s Comprehensive Plan.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the zone change.  D. Kussmann moved and T. Murphy seconded the motion to close the hearing at 11:09 a.m.  The motion was carried.

The postponed public hearing for Gary K. & Loretta M. Roehrborn was called to order at 11:10 a.m. by Chm. Penney.   

 

The applicant or representative did not appear for the hearing. 

 

D. Kussmann moved and T. Murphy seconded the motion to CONTINUE the application for Conditional Use Permit to the next scheduled Planning and Zoning Committee meeting on September 18, 2014 due to the fact that no one was present to testify on behalf of the application.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to continue the public hearing.  D. Kussmann moved and W. Wilfuer seconded the motion to close the hearing at 11:13 a.m.  The motion was carried.

 

 

DISCUSS & POSSIBLE ACTION:

 

Purchase of Department Vehicle was discussed.  D. Kussmann moved and D. Federwitz seconded the motion to purchase the 2015 Chevy Equinox from Neuville Motors, Waupaca for $21,710.  The motion was carried.

The next Planning and Zoning Committee meeting has been scheduled for Thursday, September 18, 2014.

 

T. Murphy moved and W. Wilfuer seconded the motion to adjourn the meeting at 11:43 a.m.  The motion was carried.
