WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –AUGUST 26, 2014

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Thomas A. & Roxanne Abraham property, Town of Little Wolf, the Joseph & Karla Kay Taggart property, Town of Little Wolf and the Mark VanLinn property, Town of Little Wolf.                                  

 

Chm. Penney called the meeting to order at: 9:31 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy and D. Federwitz, present.  W. Wilfuer was excused.

 

 D. Kussmann moved and T. Murphy seconded the motion to change the Public Hearing order of the agenda to 1) Mark VanLin; 2) Thomas A. & Roxanne Abraham and 3) Joseph & Karla Kay Taggart. The motion was carried.

 

D. Federwitz moved and T. Murphy seconded the motion to approve the minutes from the July 17, 2014 meeting.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:33 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Mark VanLinn:  Located in part of the East 10 acres of the NE ¼ of the NW ¼ and part of the W ½ of the NE ¼ of Sec. 18, Town of Little Wolf, lying off of Buchholz Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for the placement of a recreational vehicle intended for temporary living purposes in excess of 30 days in an AE (Agriculture Enterprise) District on approximately 8.859 acres.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Mark VanLinn was sworn in to testify.  Mr. VanLinn said he currently has a recreational vehicle on the property that he uses for hunting and there is no running water or electricity.  Mr. VanLinn said he was not aware that he needed a Conditional Use Permit.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of Little Wolf recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request and recommended approval with permits.

D. Kussmann moved and D. Federwitz seconded the motion to GRANT the application for Conditional Use Permit application.   The Town of Little Wolf Planning Commission and the Town Board of Little Wolf recommended approval of this permit.  The following conditions MUST be met: The applicant must have a County approved sanitary system on the property.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and D. Federwitz seconded the motion to close the hearing at 9:43 a.m.  The motion was carried.

The second public hearing was called to order at 9:44 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Thomas A. & Roxanne Abraham:  Located in part of the SE ¼ of the SE ¼ of Sec. 9, Town of Little Wolf, lying along County Highway N, Waupaca County, Wisconsin; for a Conditional Use Permit application for an Agriculture Related Use (animal feed storage facility) in an AE (Agriculture Enterprise) District on approximately 1.630 acres.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Derryan Abraham was sworn in to testify.  Mr. Abraham said he would like to build a feed storage facility to warehouse bagged and bulk seed with future plans to expand.  Mr. Abraham said he would have part time seasonal employees.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read two (2) letters, one (1) from the Town of Little Wolf recommending approval of the application and one (1) from the County Highway Department with recommendations.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request and recommended approval with permits.

 

D. Federwitz moved and D. Kussmann seconded the motion to GRANT the application for Conditional Use Permit application   The Town of Little Wolf Planning Commission and the Town Board of Little Wolf recommended approval of this permit.  The following conditions MUST be met:  The applicant must obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the structure. The applicant must contact the local Building Inspector to obtain a Building Permit for the structure.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and D. Federwitz seconded the motion to close the hearing at 9:52 a.m.  The motion was carried.

 The third public hearing was called to order at 9:53 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Joseph & Karla Kay Taggart:  Located on the West 30 acres in part of the NE ¼ of the NW ¼ of Sec. 18, Town of Little Wolf, lying off of Swamp Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for the placement of a recreational vehicle intended for temporary living purposes in excess of 30 days in an AE (Agriculture Enterprise) District on approximately 30 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Joseph Taggart was sworn in to testify.  Mr. Taggart said he currently has a recreational vehicle on his property that he uses for hunting and recreation. Mr. Taggart said that the recreational vehicle has been on the property for ten (10) years and he was unaware that he needed a Conditional Use Permit.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

Deb Giuffre read one (1) letter from the Town of Little Wolf recommending approval of the application with conditions.

Jackie Beyer was sworn in to testify.  Ms. Beyer said she is the Planning Commission Chairman for the Town of Little Wolf.  Ms. Beyer said the Town of Little Wolf discussed a road turn around at the end of the Town road which would open up Mr. Taggart’s easement and resolve current issues with the property owners.  Ms Beyer said Town of Little Wolf conditions would then be resolved.

 

T. Murphy moved and D. Kussmann seconded the motion to GRANT the application for Conditional Use Permit application.   The Town of Little Wolf Planning Commission and the Town Board of Little Wolf recommended approval of this permit.  The following conditions MUST be met: The applicant must have a County approved sanitary system on the property.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and D. Federwitz seconded the motion to close the hearing at 10:06 a.m.  The motion was carried.

 

APPEARANCE:  Matt Madl, Intern for the Planning and Zoning Department gave a presentation on the foundation of the intern program and his experience.

 

DISCUSS & POSSIBLE ACTION:

 

Ø  Purchase of Department Vehicle was discussed and Ryan Brown, Planning & Zoning Director, presented the proposals from the local dealerships.

Ø  2015 Budget was submitted and discussed by Ryan Brown, Planning & Zoning Director.  D. Kussmann moved and D. Federwitz seconded the motion to forward the 2015 budget to the Finance Department.  The motion was carried.
