MINUTES –JULY 31, 2014

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Darren Honer & Jamie B. Stark property, Town of Union, the Lunette Pohlman et al property, Town of Lebanon and the Paul J. & Carol J. Heid property, Town of Dayton.

 

Vice-Chm. Kussmann called the meeting to order at: 10:14 a.m. with the following members present: D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, present.  J. Penney was excused.

 

 W. Wilfuer moved and T. Murphy seconded the motion to approve the agenda as presented.  The motion was carried.

 

D. Federwitz moved and T. Murphy seconded the motion to approve the minutes from the June 26, 2014 meeting.  The motion was carried.

 

Public Comment: There was none.

 

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 10:17 a.m. by Vice-Chm. Kussmann.  Roll call was taken with the following members present: D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, present.  J. Penney was excused.  Deb Giuffre read the names of persons notified of the hearing for Darren Honer & Jamie B. Stark:  Located in part of the E ½ of the NW ¼ of Sec. 29, Town of Union, lying along Nollenberg Rd, Fire Number N8005, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Commercial Animal Facility (dog breeding) in an AE (Agriculture Enterprise) District on approximately 15 acres.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and declared it a legal hearing.

 

Jamie and Darren Honer were sworn in to testify.  Ms. Honer said she is a dog breeder of Cockapoos and would like to establish her business at her home.  Ms. Honer said she has been in the dog breeding business for ten (10) years with her mother.

 

Darren Honer said the business is a show place and a clean business.  

 

Vice-Chm. Kussmann called three times for any testimony in favor to the application.  There was none

 

Vice-Chm. Kussmann called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read two (2) letters, one (1) from the Wolf River Veterinary Clinic in favor of the application and one (1) from the Town of Union recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request and recommended approval with conditions.

D. Federwitz moved and W. Wilfuer seconded the motion to GRANT the application for a Conditional Use Permit due to the following: The Town of Union Planning Commission and the Town Board of Union recommended approval of this Conditional Use Permit.  The following conditions must be met:  The Committee is limiting the applicant to a maximum of thirty (30) adult dogs being included in this dog breeding business at any one time.  Roll call vote was taken D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  T. Murphy moved and D. Federwitz seconded the motion to close the hearing at 10:36 a.m.  The motion was carried.

The second public hearing was called to order at 10:37 a.m. by Vice-Chm. Kussmann.  Roll call was taken with the following members present: D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, present.  J. Penney was excused.  Deb Giuffre read the names of persons notified of the hearing for Lunette Pohlman et al:  Located in part of the NW ¼ of the SE ¼ of Sec. 36, Town of Lebanon, lying along County Highway T, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an AWT (Agriculture and Woodland Transition) District to an RC-G (Rural Commercial-General) District with a Conditional Use Permit application for an Outdoor Storage & Wholesaling (propane bulk storage with possible future office/shop/retail shop) on approximately 12.93 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and declared it a legal hearing.

 

Lunette Pohlman was sworn in to testify.  Ms. Pohlman said she is the seller of the property to Jeff Duch and he would like to establish a propane business.

 

Jeff Duch was sworn in to testify.  Mr. Duch said he is the owner of Wolf River Propane and would like to establish a bulk propane business on the property which requires a Petition for Zoning Map Amendment and a Conditional Use Permit application.  

 

Vice-Chm. Kussmann called three times for any testimony in favor to the application. There was none.

Les Prochnow was sworn in to testify.  Mr. Prochnow said he is the Chairman for the Town of Lebanon and that the Town of Lebanon is in favor of the application.  Mr. Prochnow expressed some concerns with the minimum lot size for RC-G (Rural Commercial-General) District and the location of the proposed business.

 

Deb Giuffre read two (2) letters, one (1) from the Town of Lebanon recommending approval of the application and one (1) from the County Highway department with recommendations.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Petition for Zoning Map Amendment and the Conditional Use Permit application request and recommended approval with conditions.

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES –

JULY 31, 2014

 

T. Murphy moved and W. Wilfuer seconded the motion to GRANT the Petition for Zoning Map Amendment due to the following:  The Town Board of Lebanon recommended approval of this request and it is consistent with the Town’s Comprehensive Plan. Roll call vote was taken: D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the zone change.  The motion was carried.

 

D. Federwitz moved and W. Wilfuer seconded the motion to GRANT the application for Conditional Use Permit due to the following:  The Town Board of Lebanon recommended approval of this Conditional Use Permit.  The following conditions MUST be met:  The applicant MUST obtain a Land Use Permit from the Planning & Zoning Office prior to the placement of the structure on the property.  The applicant MUST check with the local Building Inspector to see if a Building Permit is necessary. Roll call vote was taken:  D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Federwitz moved and W. Wilfuer seconded the motion to close the hearing at 10:57 a.m.  The motion was carried.

The third public hearing was called to order at 10:58 a.m. by Vice-Chm. Kussmann.  Roll call was taken with the following members present: D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, present.  J. Penney was excused.  Deb Giuffre read the names of persons notified of the hearing for Paul J. & Carol J. Heid:  Located in part of Government Lot 2 (island in Birchwood Lake) of Sec. 4, Town of Dayton, lying off of Birchwood Drive, Waupaca County, Wisconsin; for a Conditional Use Permit application for an Accessory Structure Prior to the Principal Building (storage shed) in an SR-20 (Sewered Residential Single-Family) District on approximately 4 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and declared it a legal hearing.

 

Paul Heid was sworn in to testify.  Mr. Heid said he has been clearing some brush from the property and would like to put up a shed to keep the tools in and because of the SR-20 (Sewered Residential Single-Family) District zoning, the construction of an accessory structure prior to a principal structure requires a Conditional Use Permit.

Larry Bauer was sworn in to testify.  Mr. Bauer said with the clear cutting and spraying he has some concerns with the water quality, runoff, wildlife and the property values of neighboring properties.

 

Kurt Westenberger was sworn in to testify.  Mr. Westenberger said he owns a lot on Birchwood Drive and has concerns with the loss of wildlife habitat and the use of the island.

 

Laura Westenberger was sworn in to testify.  Ms. Westenberger said she is also concerned about the wildlife and was under the impression it was a wildlife refuge.

 

Jacci Smith was sworn in to testify.  Ms. Smith said she is concerned about the future use of the land.

Ryan Brown, Planning & Zoning Director, explained the regulations of the maintenance for vegetation cover and the uses of the property for the SR-20 (Sewered Residential Single-Family) District.

 

Robert Ellis was sworn in to testify.  Mr. Ellis said he was speaking for informational purposes and he is the Chairman for the Chain O’ Lakes Sanitary District and explained the function of the Sanitary District. 

 

Deb Giuffre read one (1) letter from the Town of Dayton recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application and recommends approval with conditions.

 

Paul Heid came back for rebuttal.  Mr. Heid said he is only clearing the evasive buckthorn species and using environmental approved chemicals and his intentions are to improve the environment.

 

T. Murphy moved and W. Wilfuer seconded the motion to GRANT the application for Conditional Use Permit due to the following:  The Town Board of Dayton recommended approval of this Conditional Use Permit.  The following conditions MUST be met:  The design standards for the storage shed shall be as follows:  Being 5 % of the lot or 750 square feet, whichever is less, and having a maximum height of 25 feet. The applicant must obtain a Land Use Permit from the Planning & Zoning Office prior to construction of the storage shed. The applicant must check with the local Building Inspector to see if a Building Permit is necessary. Roll call vote was taken:  D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Federwitz moved and W. Wilfuer seconded the motion to close the hearing at 11:40 a.m.  The motion was carried.

 

APPEARANCE:

 

Eric Fowle, East Central Wisconsin Regional Planning Commission, discussed his 2014 Work Program, Groundwater recharge for Waupaca and surrounding Counties and the Activities Annual Report for 2013-2014.

 

DISCUSS & POSSIBLE ACTION:

 

Ryan Brown, Planning & Zoning Director, explained the Resolution for a six (6) month extension on the Moratorium on Permitting of Non-Metallic Mining Activities in Waupaca County.

 

The next Planning and Zoning Committee meeting has been scheduled for Tuesday, August 26, 2014.
