WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –JULY 17, 2014

                                

Chm. Penney called the meeting to order at: 8:35 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy and D. Federwitz present.   Wayne Wilfuer was excused.

 

 D. Federwitz moved and T. Murphy seconded the motion to approve the agenda as presented.  The motion was carried.

 

D. Kussmann moved and T. Murphy seconded the motion to approve the minutes from the May 29, 2014 meeting.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 8:37 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy and D. Federwitz present.  Deb Giuffre read the names of persons notified of the hearings for the Proposed Comprehensive Plan Amendments within the Towns of Bear Creek, Lebanon, Lind, Little Wolf, Matteson, Scandinavia, St. Lawrence, and Union.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Ryan Brown, Planning & Zoning Director, explained the process of the Proposed Comprehensive Plan Amendments and that it allows the properties to be consistent with the adopted town comprehensive plans and Waupaca County’s Farmland Preservation Plan.  

 

Joe Wilken was sworn in to testify.  Mr. Wilken said had some concerns about the properties listed and section 31 needs to be included of Wilken Farms in the Town of Matteson.

 

Chm. Penney called three times for any testimony in favor to the application for the Town of Lebanon. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application for the Town of Lebanon. There was none.

 

Neal Bolinske was sworn in to testify.  Mr. Bolinske said he has seventeen (17) acres of woodland area and does cuttings on ten (10) year intervals and had some concerns on how the Farmland Preservation plan affects his taxes.

 

Les Prochnow was sworn in to testify.  Mr. Prochnow said he is the Chairman for the Town of Lebanon and was wondering if there were any concerns with the Town of Lebanon.

 

Ryan Brown, Planning & Zoning Director, explained the requests and changes for the Town of Lebanon and the Farmland Preservation qualifications.

Carson Korth was sworn in to testify.  Mr. Korth said he was concerned about being able to build a dwelling in the AR (Agriculture Retention) zoning classification.

 

Chm. Penney called three times for any testimony in favor to the application for the Town of Lind.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application for the Town of Lind. There was none.

 

Chm. Penney called three times for any testimony in favor to the application for the Town of Union.  There was none.

 

Chm. Penney called three times for any testimony in opposition to the application for the Town of Union. There was none.

 

Brenda Parrot was sworn in to testify.  Ms. Parrot said she lives in the Town of Union and wanted to know how the zone change affects the property.

 

Greg Jackson was sworn in to testify.  Mr. Jackson said he wanted to know what is allowed in the AR (Agriculture Retention) zoning classification.

 

Arlene Shabo was sworn in to testify.  Ms. Shabo asked what her current zoning classification was on her property.

 

Roger Freiberg was sworn in to testify.  Mr. Freiberg said he wanted to know if the neighbor’s property is re-zoned if it would affect his sister’s property.

 

D. Kussmann moved and D. Federwitz seconded the motion to APPROVE the Comprehensive Plan Amendments for the Towns of Bear Creek, Lebanon, Lind, Little Wolf, Matteson, Scandinavia, St. Lawrence and Union preferred land use classifications. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to approve the amendments.  D. Kussmann moved and T. Murphy seconded the motion to close the hearing at 9:17 a.m.  The motion was carried.

Deb Giuffre read the names of persons notified of the hearings for the Petition for Zoning Map Amendments for rezones to an AR (Agriculture Retention) District to ensure that the Waupaca County Comprehensive Plan remains consistent with the locally adopted town comprehensive plans and Waupaca County’s Farmland Preservation Plan. Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

D. Federwitz moved and D. Kussmann seconded the motion to GRANT the application for                    Petition for Zoning Map Amendment for the Town of Lebanon property owners from either an AWT (Agriculture and Woodland Transition) District or an RR (Rural Residential) District to an AR (Agriculture Retention) District to ensure that the Waupaca County Comprehensive Plan remains consistent with the locally adopted town comprehensive plans and Waupaca County’s Farmland Preservation Plan. Based on the testimony presented at the public hearing, the Committee decided to GRANT the Petition for Zoning Map Amendments due to the following: The Town of Lebanon approved these requests and they are consistent with the Town’s Comprehensive Plan. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.

Based on the testimony presented at the public hearing, the Committee decided to GRANT the Petition for Zoning Map Amendments due to the following: The Town of Union approved these requests and they are consistent with the Town’s Comprehensive Plan. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit. 

 

The next Planning and Zoning Committee meeting has been scheduled for July 31, 2014.
