MINUTES –JUNE 26, 2014

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:15 a.m. on the Jamie L. & Jenifer A. Sell property, Town of Larrabee and the Terry W. & Jenni Timm Revocable Trust property, Town of St. Lawrence.                                 

 

Chm. Penney called the meeting to order at: 9:40 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.

 

 D. Federwitz moved and Wayne Wilfuer seconded the motion to approve the agenda as presented.  The motion was carried.

 

D. Kussmann moved and D. Federwitz seconded the motion to approve the minutes from the May 8, 2014 meeting.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:48 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Jamie L. & Jenifer A. Sell:  Located in part of the NW ¼ of the NW ¼ of Sec. 18, Town of Larrabee, lying along Horn Road, Fire Number E7370, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment form an RI-I (Rural Industrial-Intensive) District to an AWT (Agriculture and Woodland Transition) District on approximately 12.17 acres with a Conditional Use Permit application for a structure to be used for human habitation that doesn't meet the 22 foot minimum width requirement. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Jamie & Jenifer Sell were sworn in to testify.  Mr. Sell said he would like to move a mobile home onto the property while he builds a dwelling, which requires a Petition for Zoning Map Amendment and a Conditional Use Permit application. Mr. Sell said he plans on having the dwelling built in five years.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read two (2) letters from the Town of Larrabee recommending approval for the Petition for Zoning Map Amendment and Conditional Use Permit application.

 

Jean Gliniecki, Zoning Administrator, gave a summary and recommendations for the Petition for Zoning Map Amendment and the Conditional Use Permit application.

 

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for Petition for Zoning Map Amendment.  The Town of Larrabee Planning Commission and the Town Board of Larrabee approved this request and it is consistent with the Town’s Comprehensive Plan.  Roll call vote was taken:

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit. The Town of Larrabee Planning Commission and the Town Board of Larrabee have recommended approval of this request. The following conditions MUST be met:  The applicant MUST obtain a Land Use Permit from the Planning & Zoning Office for the structure.  The applicant MUST have an evaluation of the existing sanitary system to make sure that it is functioning properly.  The applicant MUST check with the local Building Inspector to see if a Building Permit is necessary for this structure.  This permit is valid for five (5) years, which will be until June 26, 2019.  This will allow the applicant enough time to construct a new dwelling by that date.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and Wayne Wilfuer seconded the motion to close the hearing at 10:01 a.m.  The motion was carried.

The second public hearing was called to order at 10:02 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Terry W. & Jenni Timm Revocable Trust:  Located in part of the NW ¼ of the NE ¼ of Sec. 9, Town of St. Lawrence, lying along Cozy Pine Road, Fire Number N6819, Waupaca County, Wisconsin; for a Conditional Use Permit application for a structure to be used for human habitation that doesn't meet the 22 foot minimum width requirement in an AR (Agriculture Retention) District on approximately 2 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Terry Timm was sworn in to testify.  Mr. Timm said he purchased the property with the existing structure and used it for hunting.  Mr. Timm said he was unaware of the permitting process and regulations for human habitation.

 

Ryan Brown, Planning & Zoning Director, explained the regulations regarding the sanitary facilities and the structure used for human habitation. 

 

Chm. Penney called three times for any testimony in favor to the application.

 

Greg Baumgart was sworn in to testify.  Mr. Baumgart said he is the Chairman for the Town of St. Lawrence and the Town of St. Lawrence is in favor of the Conditional Use Permit application.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of St. Lawrence recommending approval of the application.

Federwitz moved and Wayne Wilfuer seconded the motion to GRANT the application for                   Conditional Use Permit application.  The Town of St. Lawrence Planning Commission and the Town Board of St. Lawrence have recommended approval of this request. The applicant MUST have a County approved sanitary system on the property.  The applicant MUST obtain a Building Permit from the local Building Inspector for this structure.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and Wayne Wilfuer seconded the motion to close the hearing at 10:10 a.m.  The motion was carried.

 The third continuation public hearing was called to order at 10:11 a.m. by Chm. Penney for Christopher & Therese Gilling:  Located in Sec. 5, Town of Little Wolf, lying along Flater Road, Fire Number N7130, Waupaca County, Wisconsin; for a Continuation of the Conditional Use Permit application to exceed the allowable number of animal units in an AE (Agriculture Enterprise) District on approximately 10 acres. Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

 The applicant did not appear for the hearing.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application.

 

Jackie Beyer said she is the Clerk for the Town of Little Wolf and explained that the Town of Little Wolf is opposed to the Conditional Use Permit application.  Ms. Beyer said the applicant has not been compliant with the conditions requested by the Town of Little Wolf.

 

Ryan Brown, Planning & Zoning Director, explained the permitted use for animals in the current zoning classification and the violation process.

 

D. Kussmann moved and D. Federwitz seconded the motion to DENY the application for Conditional Use Permit application.  The Town of Little Wolf’s recommendation was to deny the application due to the applicant’s inability to abide by the conditions set by the Town. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to deny the permit.  D. Kussmann moved and T. Murphy seconded the motion to close the hearing at 10:28 a.m.  The motion was carried.

 

 

 

 

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES –

REVIEW:

 

The Conditional Use Permit application for Kermit W. & Delores E. Derozier  (CP-009-13) in Sec. 15, Town of Matteson for the replacement of a structure to be used for human habitation that doesn't meet the 22 foot minimum width requirement in an AWT (Agriculture and Woodland Transition) District on approximately 20 acres was discussed by the Planning & Zoning Committee.  

 

D. Kussmann moved and D. Federwitz seconded the motion to table the condition to complete the foundation project by the deadline date, until September 15, 2015 and decided that an escrow account needs to be set up by July 1, 2014.  This escrow account will be set up as direct deposit with the applicant and his nephew as both parties have consented to it and will be as follow: The account will be set up at the 1st National Bank in Clintonville. The account will be set up for direct deposit of $450.00 per month. The account will be in the names of Kermit Derozier and the Town of Matteson.  The Town will keep the Planning & Zoning Office informed as to the status of the account.  The motion was carried.
