MINUTES –MAY 29, 2014

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Peter L. & Annette A. Ziebell property, Town of Little Wolf; Malia L. Ryan property, Town of Little Wolf; William R. & Beverly J. Tusler property, Town of Weyauwega; Cliff Gregg & Dale Laugavitz property, Town of Lind and Kenneth P. Claussen property, Town of Waupaca.                                

 

Chm. Penney called the meeting to order at 10:00 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.

 

 D. Federwitz moved and T. Murphy seconded the motion to approve the agenda as presented.  The motion was carried.

 

D. Kussmann moved and T. Murphy seconded the motion to approve the minutes from the April 17, 2014 meeting.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 10:03 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Peter L. & Annette A. Ziebell:  Located in part of the NW ¼ of the SW ¼ of Sec. 10, Town of Little Wolf, lying along Highway 22-110, Fire Number N6628, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Major Home Occupation (expansion of an existing heating & cooling business) in an AE (Agriculture Enterprise) District on approximately 7.31 acres.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Peter Ziebell was sworn in to testify.  Mr. Ziebell said he would like to expand the garage for storage for the existing heating and cooling business.  Mr. Ziebell said he will not be increasing the employees.

 

Ryan Brown, Planning & Zoning Director, explained the Major Home Occupation ordinance regulations.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of Little Wolf recommending approval of the application.

 

D. Federwitz moved and D. Kussmann seconded the motion to GRANT the application for Conditional Use Permit.  The Town of Little Wolf Planning Commission and the Town Board of Little Wolf have approved this request.  The following conditions must be met:  The applicant must obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the addition to the structure. The applicant must contact the Commercial Building Inspector to see if a Building Permit is necessary for the construction of the addition to the structure.  If not, then you must contact the local Building Inspector

The second public hearing was called to order at 10:19 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Malia L. Ryan:  Located in part of the NE ¼ of the NW ¼ of Sec. 15, Town of Little Wolf, lying along Progress Road, Fire Number E6211, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Mini-Warehouse in an AE (Agriculture Enterprise) District on approximately 11.81 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Malia Ryan was sworn in to testify.  Ms. Ryan said she would like to construct a mini storage unit on her property which requires a Conditional Use Permit.  Ms. Ryan said she would like to construct fifty (50) units with no lighting or fencing.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application.

 

Keith Brown was sworn in to testify.  Mr. Brown said he is representing Patrick Murphy of Murphy Development, the existing apartments that adjoin Ms. Ryan’s property.  Mr. Brown said they are opposed to the proposed mini-storage units because of possible increased traffic, safety, dust and noise.

 

Cheryl Scheurermann was sworn in to testify.  Ms. Scheurermann said she owns the property across the street of the proposed mini-storage units.  Ms. Scheurermann said she is concerned with possible vandalism, traffic and noise.

 

Deb Giuffre read three (3) letters, two (2) from neighboring property owners opposed to the application and one (1) from the Town of Little Wolf recommending approval of the application with conditions.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit request.

 

Jackie Beyer was sworn in to testify.  Ms. Beyer said she is the Clerk and Planning Commission Chairman for the Town of Little Wolf.  Ms. Beyer said that there was no opposition at the Town of Little Wolf’s Town meeting when they placed the conditions for the Conditional Use Permit application.  Ms. Beyer suggested the Planning and Zoning Committee put additional conditions on the Conditional Use Permit application to address the concerns.  

 

Malia Ryan came back for rebuttal.  Ms. Ryan said she would be open to suggestions to address the concerns.

D. Kussmann moved and W. Wilfuer seconded the motion to GRANT the application for the Conditional Use Permit.   The Town of Little Wolf Planning Commission and the Town Board of Little Wolf have approved this request.  The following conditions must be met:  All garbage, debris, etc. shall be contained at all times.  All vegetation surrounding the storage units shall be maintained.  Must plant evergreen trees on both sides of the structure as a buffer and/or black top the driveway.  If the driveway is not black topped then rotten granite shall be used in the driveway.  Must have shrouded security lighting all around the structure.  The applicant must obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the Mini-Warehouse. The applicant must obtain a Building Permit from the Building Inspector prior to the construction of the Mini-Warehouse and if he doesn’t require a permit; then you need to contact your local Building Inspector.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and T. Murphy seconded the motion to close the hearing at 11:01 a.m.  The motion was carried.

The third public hearing was called to order at 11:02 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for William R. & Beverly J. Tusler:  Located in part of Government Lot 5 of Sec. 11, Town of Weyauwega, lying at the end of Gills Landing Drive, Waupaca County, Wisconsin; for a Conditional Use Permit application for the placement of a recreational vehicle intended for temporary living purposes in excess of 30 days in an PVRF (Private Recreation and Forestry) District and an FW (Floodway) District.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

William Tusler was sworn in to testify.  Mr. Tusler said he is the property owner and the recreational vehicle is owned by a friend.  Mr. Tusler said he received a letter from Waupaca County that he needed a permit for the recreational vehicle to be on the property.

 

Jason Snyder, Deputy Zoning Administrator, explained the requirements of the sanitary facilities for a recreational vehicle.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

Deb Giuffre read two (2) letters, one (1) from the Town of Weyauwega and one (1) from the Town of Weyauwega Planning Commission recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit request.

 

D. Federwitz moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit.  The Town of Weyauwega Planning Commission and the Town Board of Weyauwega have approved this request.  The following conditions must be met:  The applicant must have a County

approved sanitary system on the property.  The placement of a camping unit located in the Floodplain District shall not occupy any site for more than 180 consecutive days, at which time the camping unit must be removed from the floodplain for a minimum of 24 hours. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and D. Federwitz seconded the motion to close the hearing at 11:14 a.m.  The motion was carried.

The fourth public hearing was called to order at 11:15 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Cliff Gregg & Dale Laugavitz:  Located in part of the E ½ of the SE ¼ of the SE ¼ of Sec. 35, Town of Lind, lying along Zabel Road, Fire Number E4447, Waupaca County, Wisconsin; for a Conditional Use Permit application for a structure to be used for human habitation that doesn't meet the 22 foot minimum width and the 6 inch roof overhang requirements in an AE (Agriculture Enterprise) District on approximately 20 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Dale Laugavitz was sworn in to testify.  Mr. Laugavitz said that he and Mr. Gregg use the property for hunting and stay in the campers.  Mr. Laugavitz said they would like to place a pre-fabricated 14 x 36 cabin on a cement foundation which requires a Conditional Use Permit.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application.

 

Sue Gagne was sworn in to testify.  Ms. Gagne said she owns neighboring property and has concerns that the proposed Conditional Use Permit would affect property value.  Ms. Gagne also requested the location of the proposed cabin be changed or trees be planted to block the view.

 

Deb Giuffre read two (2) letters, one (1) from the Town of Lind and one (1) from the Town of Lind Planning Commission recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request.

 

Dale Laugavitz came back for rebuttal.  Mr. Laugavitz said the proposed cabin would be an improvement to the property and that they already planted trees.

 

D. Federwitz moved and Wayne Wilfuer seconded the motion to GRANT the application for Conditional Use Permit application.  The Town of Lind Planning Commission and the Town Board of Lind have approved this request.  The following conditions must be met:  The applicant must obtain a Land Use Permit from the Planning & Zoning Office prior to construction of the cabin on the property.  The applicant must have a County approved sanitary system on the property.  The applicant must obtain a Building Permit

from the local Building Inspector prior to construction of the cabin on the property.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and W. Wilfuer seconded the motion to close the hearing at 11:34 a.m.  The motion was carried.

The fifth public hearing was called to order at 11:40 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, W. Wilfuer and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Kenneth P. Claussen:  Located in part of the S ½ of the NE ¼ of the SE ¼ of Sec. 3, Town of Waupaca, lying along Casey Road, Fire Number E4024, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Contractor Shop (automobile repair) in an AWT (Agriculture and Woodland Transition) District on approximately 20 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Kenneth Claussen was sworn in to testify.  Mr. Claussen said he would like to continue the automotive repair business which requires a Conditional Use Permit.  Mr. Claussen said the intent of the structure was for personal automotive repair use and then the business developed. 

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of Waupaca recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit request and conditions to be applied.

 

T. Murphy moved and Wayne Wilfuer seconded the motion to GRANT the application for Conditional Use Permit.  The Town Board of Waupaca has approved this request.  The following conditions must be met:  There shall be a maximum of four (4) customer vehicles parked outside at any one time.  There shall be no outside storage of junk or vehicle parts. There shall be a County approved sanitary facility on the property.  The applicant must contact the Commercial Building Inspector to see if a Building Permit is necessary.  If not, then you must contact the local Building Inspector to see if a Building Permit is necessary.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  W. Wilfuer moved and D. Kussmann seconded the motion to close the hearing at 11:54 a.m.  The motion was carried.

 

REVIEW

 

Ryan Brown, Planning & Zoning Director discussed the final copy of the Selected Revisions to the Waupaca County Shoreland Zoning Ordinance, Waupaca County Code of Ordinances, Chapter 32; Waupaca County Zoning Ordinance, Waupaca County Code of Ordinances, Chapter 34;

Waupaca County Floodplain Ordinance, Waupaca County Code of Ordinances, Chapter 36; and the Waupaca County Subdivision Ordinance, Waupaca County Code of Ordinances, Chapter 37.  D. Federwitz moved and D. Kussmann seconded the motion to APPROVE the Selected Revisions and recommend them to the Waupaca County Board for their approval at their July 15, 2014 meeting.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to approve the revisions. The motion was carried.
