MINUTES –MAY 8, 2014

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Hillside Salvage & Repair LLC property, Town of Caledonia; and the Ken C. Menting property, Town of Lind.                                  

 

Chm. Penney called the meeting to order at: 9:45 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy and W. Wilfuer present.  D. Federwitz was excused.

 

D. Kussmann moved and T. Murphy seconded the motion to approve the agenda as presented.  The motion was carried.

 

T. Murphy moved and Wayne Wilfuer seconded the motion to approve the minutes from the January 9, 2014 and March 6, 2014 meeting.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:50 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, and W. Wilfuer, all present.  Deb Giuffre read the names of persons notified of the hearing for Hillside Salvage & Repair LLC:  Located in part of the SE ¼ of the SE ¼ of Sec. 3, Town of Caledonia, lying along County Highway W, Fire Number N2185, Waupaca County, Wisconsin; for a Conditional Use Permit application for an Outdoor Maintenance Service (automobile repair and continue existing used automobile sales) in an RI-I (Rural Industrial-Intensive) District on approximately 4.75 acres.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Allan Schumacher was sworn in to testify.  Mr. Schumacher said he would like to convert the existing salvage business to an automobile repair and sales service.  

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

Deb Giuffre read one (1) letter from the Town of Caledonia recommending approval of the application with conditions.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request and recommendations.

 

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit. The Town of Caledonia Planning Commission and the Town Board of Caledonia have recommended approval of this request with conditions.  The following conditions must be met:  Approval of the Conditional Use Permit is based on the expectation that the applicant will exit the wholesale salvage operations. Additionally it is expected that the applicant will limit the hours of operation for any

outside work activities to daylight. Any storage of vehicles for the new business will be behind a fence/screening. No more than 25 cars will be stored on the property at one time for the new business. 

Applicant will be removing the cars from the existing salvage business. Required parking includes one (1) parking space per three hundred (300) square feet of gross floor area in the principal building(s), plus adequate parking for the storage of vehicles awaiting service or pick-up. This Conditional Use Permit will be reviewed by the Committee in two (2) years, which will be by May 8, 2016.  The applicant must obtain a Land Use Permit from the Planning & Zoning Office for any new construction on the property and also check to see if a Building Permit is necessary from the local Building Inspector. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and T. Murphy seconded the motion to close the hearing at 10:08 a.m.  The motion was carried.

The second public hearing was called to order at 10:09 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, and W. Wilfuer, all present.  Deb Giuffre read the names of persons notified of the hearing for Ken C. Menting: Located in part of the NW ¼ of the SW ¼ of Sec. 31, Town of Lind, lying along Bird Dog Lane, Fire Number E2569, Waupaca County, Wisconsin; for a Conditional Use Permit application for the placement of a recreational vehicle intended for temporary living purposes in excess of 30 days in an AR (Agriculture Retention) District on approximately 3 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Ken Menting was sworn in to testify.  Mr. Menting said he would like to withdraw the Conditional Use Permit application because the campers have been removed from the property.

 

Ryan Brown, Planning & Zoning Director, explained how the removal of the campers effects the Conditional Use Permit application.

 

Jeff Henneman, Land Use/Code Enforcement Specialist, explained how the request for the Conditional Use Permit application occurred.

Deb Giuffre read one (1) letter from the Town of Lind recommending denial of the application.

 

T. Murphy moved and Wayne Wilfuer seconded the motion to DENY the application for the Conditional Use Permit due to the fact that the applicant testified at the public hearing that he had removed the recreational vehicle off the property.  The Town Board of Lind and the Town of Lind Building Inspector have recommended that the structure that is located on this property shall be removed from the property by June 30, 2014. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and T. Murphy seconded the motion to close the hearing at 10:20 a.m.  The motion was carried.

The third public hearing was called to order at 10:21 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, and W. Wilfuer, all present for the Selected Revisions to the Waupaca County Shoreland Zoning Ordinance, Waupaca County Code of Ordinances, Chapter 32; Waupaca County Zoning Ordinance, Waupaca County Code of Ordinances, Chapter 34; Waupaca County Floodplain Ordinance, Waupaca County Code of Ordinances, Chapter 36 and the Waupaca County Subdivision Ordinance, Waupaca County Code of Ordinances, Chapter 37.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Ryan Brown, Planning & Zoning Director, presented the proposed amendments to the Waupaca County Shoreland, Zoning, Floodplain and Subdivision Ordinances.

 

Patricia Craig was sworn in to testify.  Mrs. Craig said she had some concerns regarding Sec. 6.09 Shooting Ranges for Firearms, (3) (b) Firing Limitations, over navigable water and location one-half (½) mile of residents.  (c) In General, (5) signs, (6) (7) (8) National Rifle Association Range Source Book.

 

Bob Ellis and Kay Ellis were sworn in to testify.  Mr. and Mrs. Ellis had some suggestions for some word changes and also revisions should be dated.  Mr. and Mrs. Ellis had some concerns regarding the Sewered Residential zoning classification including duplex.

 

Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator, addressed the concerns and suggestions.

Mike Orr was sworn in to testify.  Mr. Orr said he is representing the Town of Waupaca and suggested that these changes to the proposed revisions be submitted back to the Committee in written form prior to their final approval.

 

D. Kussmann moved and T. Murphy seconded the motion to CONTINUE the Selected Revisions to the Waupaca County Shoreland Zoning Ordinance, Waupaca County Code of Ordinances, Chapter 32; Waupaca County Zoning Ordinance, Waupaca County Code of Ordinances, Chapter 34;  Waupaca County Floodplain Ordinance, Waupaca County Code of Ordinances, Chapter 36 and the Waupaca County Subdivision Ordinance, Waupaca County Code of Ordinances, Chapter 37; and recommend that these changes to the proposed revisions be presented to the Committee in written form prior to their final approval at their next meeting on May 29, 2014.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; W. Wilfuer—yes and T. Murphy—yes, unanimous vote to continue the Selected Revisions.  The motion was carried at 10:16 a.m.

the Conditional Use Permit and unless the Planning & Zoning Office receives any complaints, this permit does not need to come back for any further review.  The motion was carried.

 

 

The next Planning and Zoning Committee meeting has been scheduled for May 29, 2014.
