MINUTES –DECEMBER 12, 2013

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:15 a.m. on the Helen R. Adams property, Town of Caledonia; the Breezy Hill Farms LLC property, Town of Lind and the Nancy Melum property, Town of Scandinavia.                              

 

Chm. Penney called the meeting to order at 10:00 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

 D. Kussmann moved and D. Federwitz seconded the motion to change the Public Hearing order of the agenda to 1) Helen R. Adams; 2) Breezy Hill Farms LLC; 3) Nancy Melum; 4) Comprehensive Plan Amendment, Town of Dayton; and the Creation of Chapter 48, Waupaca County Code of Ordinances, Mobile Service Facilities and Support Structures.   The motion was carried.

 

R. Ellis moved and D. Federwitz seconded the motion to approve the minutes from the October 17, 2013 meeting.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 10:06 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Helen R. Adams:  Located in Sec. 14, Town of Caledonia, lying along Guhl Road, Fire Number E9250, Waupaca County, Wisconsin; for a Petition for a Zoning Map Amendment from a PVRF (Private Recreation and Forestry) District to an AWT (Agriculture and Woodland Transition) District on approximately 4.50 acres to adjust the property line to have all the farmstead improvements on one (1) parcel with the same zoning district.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Helen Adams was sworn in to testify.  Ms. Adams said she would like to consolidate the farmstead buildings onto one parcel and to also allow for a conservation easement and this would require a zone change.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read two (2) letters, one (1) from the Township of Caledonia and one (1) from the Town of Caledonia Planning Commission recommending approval of the application.

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – December 12, 2013

 

D. Federwitz moved and R. Ellis seconded the motion to GRANT the application for the Petition for Zoning Map Amendment.  The Town of Caledonia Planning Commission and the Town Board of Caledonia approved this amendment and it is consistent with the Town’s Comprehensive Plan.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the zone change.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:16 a.m.  The motion was carried.

The second public hearing was called to order at 10:17 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Breezy Hill Farms LLC:  Located in Sec. 24, Town of Lind, lying along Railroad Grade Road, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an AR (Agriculture Retention) District to an AE (Agriculture Enterprise) District on approximately 37.83 acres to combine two (2) adjoining parcels making them one (1) parcel with the same zoning district.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Steve Bartel was sworn in to testify.  Mr. Bartel said he would like to combine two (2) parcels that are not the same zoning classification to use for farming which requires a Petition for Zoning Map Amendment.

 

Chm. Penney called three times for any testimony in favor to the application.

 

Art Richardson was sworn in to testify.  Mr. Richardson said he is the Chairman for the Town of Lind Planning Commission and that the request for the Petition for Zoning Map Amendment is consistent with the Town’s Comprehensive Plan.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of Lind recommending approval of the application.

 

T. Murphy moved and R. Ellis seconded the motion to GRANT the application for the Petition for Zoning Map Amendment.  The Town of Lind Planning Commission and the Town Board of Lind approved this amendment and it is consistent with the Town’s Comprehensive Plan.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the zone change.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:24 a.m.  The motion was carried.

The third public hearing was called to order at 10:25 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Nancy Melum: Located in Sec. 35, Town of Scandinavia, lying off of Highway 49, Fire Number N5315, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from a PVRF (Private Recreation and Forestry) District to an AE (Agriculture Enterprise) District on approximately three (3) acres to adjust a property line to accommodate the encroachment of existing buildings.. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Nancy Melum was sworn in to testify.  Ms. Melum said the property line needs to be adjusted to allow for the existing buildings and the parcels are different zoning classifications which require a Petition for Zoning Map Amendment. 

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

Deb Giuffre read two (2) letters, one (1) from the Town of Scandinavia and one (1) from the Chairman for the Town of Scandinavia recommending approval of the application.

 

D. Federwitz moved and T. Murphy seconded the motion to GRANT the application for Petition for Zoning Map Amendment.  The Town of Scandinavia Planning Commission and the Town Board of Scandinavia approved this amendment and it is consistent with the Town’s Comprehensive Plan.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the zone change.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:29 a.m.  The motion was carried.

The fourth public hearing was called to order at 10:33 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for the Proposed Comprehensive Plan Amendment: The proposed amendment to the Comprehensive Plan Preferred Land Use Map is within the Town of Dayton.   The map amendment is to ensure that the Waupaca County Comprehensive Plan remains consistent with the locally adopted comprehensive plans. Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Ryan Brown, Planning & Zoning Director, explained the proposed Comprehensive Plan Amendment for the Town of Dayton.  Mr. Brown said the Town of Dayton proposed a Comprehensive Plan Amendment to make their districts into more planning districts.  This will allow for more flexibility with the Town’s Plan and it will allow SR-20 (Sewered Residential Single-Family) District properties to be zoned to appropriate residential classifications.

Chris Klein was sworn in to testify.  Mr. Klein said he is the Chairman for the Town of Dayton and the Town of Dayton Planning Commission and they are in favor of the proposed Comprehensive Plan Amendment, which will make the Town’s Plan much cleaner for the Town as well as staff.  Dayton has also added the Hamlet District which allows for mixed uses which will make it easier for compatible uses to get approval without Plan Amendments and zone changes. 

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

R. Ellis moved and T. Murphy seconded the motion to APPROVE the Comprehensive Plan Amendment for the Town of Dayton.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to approve the amendment.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:41 a.m.  The motion was carried.

The fifth public hearing was called to order at 10:42 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for the Creation of Chapter 48, Waupaca County Code of Ordinances, Mobile Service Facilities and Support Structures.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Ryan Brown, Planning & Zoning Director, explained the Creation of Chapter 48, Waupaca County Code of Ordinances, Mobile Service Facilities and Support Structures as a stand-alone ordinance.  Also, that the current Section 12 of the Waupaca County Zoning Ordinance, Chapter 34 of the Waupaca County Code of Ordinances be repealed in its entirety.

 

Jim Curns was sworn in to testify.  Mr. Curns expressed concern with towers and private airports regarding notification and safety.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

D. Kussmann moved and D. Federwitz seconded the motion to APPROVE the Creation of Chapter 48, Waupaca County Code of Ordinances, Mobile Service Facilities and Support Structures and recommend it to the Waupaca County Board for their approval at their next meeting.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to approve the ordinance.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 11:05 a.m.  The motion was carried.

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – December 12, 2013

 

 

APPEARANCE:

 

Scott Siegel, Siegel Auto & Recycling LLC for a review on a Conditional Use Permit (CP-13-08) in Sec. 35, Town of Helvetia for a salvage yard.  The Planning & Zoning Committee decided that Mr. Siegel must plant trees as a natural buffer on the south side of his property towards the road and put slats in the current fencing.  This shall be completed and be reviewed by the Planning and Zoning Committee by August 1, 2014.

 

 

DISCUSSION AND POSSIBLE ACTION:

 

Ø  Resolution to Amend Waupaca County Ordinance No. 45 of the General Code of Ordinances Comprehensive Plan Map.  D. Kussmann moved and R. Ellis seconded the motion to approve the  resolution.  The motion was carried.

Ø  Waupaca County Planning & Zoning Fee Schedule (Add Mobile Service Facilities and Support Structures fee).  R. Ellis moved and T. Murphy seconded the motion to approve adding the Mobile Service Facilities and Support Structures fee.  The motion was carried.

Ø  Discussion only -- Resolution opposing loss of local control.

 

 

The next Planning and Zoning Committee meeting has been scheduled for January 9, 2014.
