WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –November 14, 2013

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:15 a.m. on the Karl J. Driebel property, Town of Helvetia and the Robert J. & Ann M. Bubb property, Town of Iola.                                  

 

Chm. Penney called the meeting to order at: 9:54 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

 R. Ellis moved and T. Murphy seconded the motion to approve the agenda as presented.  The motion was carried.

 

D. Federwitz moved and D. Kussmann seconded the motion to approve the minutes from the September 12, 2013 meeting.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:58 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for the proposed amendment to the Comprehensive Plan Preferred Land Use Map within the Town of Helvetia. Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Ryan Brown, Planning & Zoning Director, explained the proposed amendment to the Comprehensive Plan for the Town of Helvetia.  Mr. Brown said the Town of Helvetia proposed Comprehensive Plan Amendment is to allow a Petition for Zoning Map Amendment from a PVRF (Private Recreation and Forestry) District to a RR (Rural Residential) for a two (2) acre parcel to be created to accommodate a land division.  

 

Karl Driebel was sworn in to testify.  Mr. Driebel said he is the property owner and would like to create a two (2) acre parcel which requires a Petition for Zoning Map Amendment and Comprehensive Plan Amendment.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of Helvetia recommending approval of the application.

 

T. Murphy moved and D. Kussmann seconded the motion to APPROVE the amendment to the Comprehensive Plan Preferred Land Use Map within the Town of Helvetia.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to approve the amendment.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:04 a.m.  The motion was carried.

 

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – November 14, 2013

                                                    

The second public hearing was called to order at 10:05 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Karl J. Driebel:  Located in part of the SW ¼ of the NE ¼ of Sec. 4, Town of Helvetia, lying along County Highway G, Fire Number E3598, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from a PVRF (Private Recreation and Forestry) District to a RR (Rural Residential) District to accommodate a land division and to be consistent with the current use and the Town’s Comprehensive Plan on approximately two (2) acres.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Chm. Penney said we already heard testimony from Mr. Driebel, the applicant, and the reason for the request for the Petition for Zoning Map Amendment.  

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read two (2) letters, one (1) from the Town of Helvetia recommending approval of the application and one (1) from the County Highway Department with comments regarding access.

 

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for the Petition for Zoning Map Amendment.   The Town of Helvetia Planning Commission and the Town Board of Helvetia approved this amendment and it is consistent with the Town’s Comprehensive Plan.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the zone change.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:10 a.m.  The motion was carried.

 The third public hearing was called to order at 10:11 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Robert J. & Ann M. Bubb:  Located in part of the NW ¼ of the NE ¼ of Sec. 9, Town of Iola, lying along Anderson Road, Fire Number N9214, Waupaca County, Wisconsin; for a Conditional Use Permit application for the placement of two (2) recreational vehicles intended for temporary living purposes in excess of thirty (30) days (campground) in an AWT (Agriculture and Woodland Transition) District on approximately 5.4 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Robert Bubb was sworn in to testify.  Mr. Bubb said he would like to place two (2) recreational vehicles on the property for recreational use which requires a Conditional Use Permit application.

 

Ryan Brown, Planning & Zoning Director, explained the Ordinance and how it relates to the requested Conditional Use Permit application regarding the campground.

 

Chm. Penney called three times for any testimony in favor to the application.

 

Larry Thoe was sworn in to testify.  Mr. Thoe said he is the Chairman for the Town of Iola and the Town of Iola is in favor of the application.

Deb Giuffre read one (1) letter from the Town of Iola recommending approval of the application.

 

D. Federwitz moved and D. Kussmann seconded the motion to GRANT the application for Conditional Use Permit.  The Town of Iola Planning Commission and the Town Board of Iola recommended approval of this permitThe following conditions must be met:  The Committee is limiting the applicant to a maximum of two (2) recreational vehicles to be parked on the property in excess of thirty (30) calendar days. The applicant must have a County approved sanitary system on the property.  The recreational vehicle must remain “road ready” at all times. The applicant must keep the property neat and clean. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:33 a.m.  The motion was carried.

 

REVIEW:

 

Ø  Conditional Use Permit (CP-011-95) for Randy & Dawn Loughrin located in Sec. 9, Town of Weyauwega for mini storage on approximately five (5) acres in an RC-G (Rural Commercial - General) District.  D. Kussmann moved and R. Ellis seconded the motion to approve this review of the Conditional Use Permit due to the following:  Through the Comprehensive Planning process this property is now in the RC-G (Rural Commercial - General) District which allows mini storage as a permitted use.  The condition on the original decision dated July 13, 1995 has been removed.  The Committee does not need to review any future mini storage structures prior to being built has been removed.  The property owner will need to obtain a Land Use Permit for the construction of any future mini storage structures.  The motion was carried.

 

Ø  Telecommunication Tower Ordinance/Fee Schedule revisions were discussed.

 

Ø  Ryan Brown, Planning & Zoning Director, gave a campground update regarding the compliance letter sent to the campgrounds and the response from Wisconsin Association of Campground Owners (WACO).

The next Planning and Zoning Committee meeting has been scheduled for Thursday, December 12, 2013.

 

D. Kussmann moved and R. Ellis seconded the motion to adjourn the meeting at 11:02 a.m.  The motion was carried.
