MINUTES –October 17, 2013

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:15 a.m. on the Faldet Farms Inc. property, Town of Iola and the Charles W. & Janice R. Close, Town of Farmington.   

                        

Chm. Penney called the meeting to order at: 9:30 a.m. with the following members present:  J. Penney, T. Murphy, R. Ellis and D. Federwitz, present.  D. Kussmann was excused.

 

 R. Ellis moved and T. Murphy seconded the motion to approve the agenda as presented.  The motion was carried.

 

D. Federwitz moved and R. Ellis seconded the motion to approve the minutes from the June 6, 2013 and August 27, 2013 meeting.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:38 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, T. Murphy, R. Ellis and D. Federwitz, present.  D. Kussmann was excused.   Deb Giuffre read the names of persons notified of the hearing for Kermit W. & Delores E. Derozier:  Located in Sec. 15, Town of Matteson, lying along Highway 156, Fire Number E11122, Waupaca County, Wisconsin; to amend the conditions for a Conditional Use Permit application for the replacement of a structure to be used for human habitation that does not meet the twenty-two (22)                   foot minimum width requirement in an AWT (Agriculture and Woodland Transition) District on approximately twenty (20) acres.  Chm. Penney read the general procedure and declared it a legal hearing.

 

Ryan Brown, Planning & Zoning Director, gave a summary of the amendment to the Conditional Use Permit application with the Town of Mattson’s provision.

 

DuWayne Federwitz said he is the Chairman for the Town of Matteson.  Mr. Federwitz explained the Town of Matteson’s ordinance and conditions request.

 

Kermit Derozier said he attended the Town of Matteson’s meeting and was in agreement with the conditions.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

R. Ellis moved and D. Federwitz seconded the motion to Grant the application for Conditional Use Permit application.  The Town of Matteson Planning Commission and the Town Board of Matteson have recommended approval of this request with conditions.   The following conditions MUST be met:  The applicant shall have a HUD (U.S. Department of Housing & Urban Development) compliant foundation incorporating either a concrete pad or block wall.  The applicant must let the Town of Matteson know by

January 1, 2014 which foundation will be installed.  The skirting and tie downs shall be in place by November 1, 2013 and this will be verified by the Planning & Zoning Office.  The whole foundation project shall be completed by June 1, 2014 and if it is not, the Town of Matteson has the right to remove the manufactured home from the property.  All unused appliances shall be properly disposed.   All unused tires shall be properly disposed.  Current mobile home must be moved or dismantled and removed from the Town of Matteson immediately.  All junk cars shall be removed and properly disposed.  Compliance of the above four conditions will be reviewed in one (1) year, which will be by July 9, 2014.  The existing sanitary system shall be evaluated.  If the building sewer is altered in any way, a Reconnect Permit shall be obtained from the Waupaca County Planning & Zoning Office.  The applicant shall obtain a Land Use Permit from the Waupaca County Planning & Zoning Office prior to the placement of the proposed mobile home.  The applicant shall check with the local Building Inspector to see if a Building Permit is necessary.  Roll call vote was taken:  J. Penney—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  T. Murphy moved and R. Ellis seconded the motion to close the hearing at 9:56 a.m.  The motion was carried.

The second public hearing was called to order at 9:57 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, T. Murphy, R. Ellis and D. Federwitz, present.  D. Kussmann was excused.  Deb Giuffre read the names of persons notified of the hearing for Faldet Farms Inc.:  Located in Sec. 35, Town of Iola, lying along Highway 49, Fire Number N7649, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an RR (Rural Residential) to an AWT (Agriculture and Woodland Transition) District to accommodate a boundary line adjustment between two adjoining parcels one being in an RR (Rural Residential) District and one being in an AWT (Agriculture and Woodland Transition) District on approximately 5.99 acres.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Chm. Penney read the general procedure and declared it a legal hearing.

 

Larry Thoe was sworn in to testify.  Mr. Thoe said he is the agent for Faldet Farms Inc. and the Chairman for the Town of Iola.  Mr. Thoe said that Faldet Farms Inc. is requesting to adjoin 5.99 acres zoned RR (Rural Residential) to an existing parcel which requires a Petition for Zoning Map Amendment.  Mr. Thoe said the Town of Iola is in favor of the Petition for Zoning Map Amendment.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of Iola recommending approval of the application.

 

R. Ellis moved and T. Murphy seconded the motion to GRANT the application for Petition for Zoning Map Amendment.  The Town of Iola Planning Commission and the Town Board of Iola approved this amendment and it is consistent with the Town’s Comprehensive Plan.  Roll call vote was taken:  J. Penney—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.

 The third public hearing was called to order at 10:05 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, T. Murphy, R. Ellis and D. Federwitz, present.  D. Kussmann was excused.   Deb Giuffre read the names of persons notified of the hearing for Charles W. & Janice R. Close:  Located in Sec. 36, Town of Farmington, lying along Holmes Road, Fire Number E2438, Waupaca County, Wisconsin; for a Conditional Use Permit application for the replacement of a recreational vehicle intended for temporary living purposes in excess of thirty (30) days in an SR-20 (Sewered Residential Single-Family) District.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Chm. Penney read the general procedure and declared it a legal hearing.

 

Charles Close was sworn in to testify.  Mr. Close said he would like to replace the current recreational vehicle with a newer model which will remain within the same footprint which requires a Conditional Use Permit application.

 

Chm. Penney called three times for any testimony in favor to the application.

 

Dale Trinrud was sworn in to testify.  Mr. Trinrud said he is the Chairman for the Town of Farmington and the Town of Farmington is in favor of the Conditional Use Permit application.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of Farmington recommending approval of the application.

 

D. Federwitz moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit.    The Town Board of Farmington was in favor of this request and it is consistent with the Town Comprehensive Plan.  The following conditions MUST be met:  The applicant shall have the existing sanitary system evaluated to make sure that it is functioning properly.  If the building sewer is altered in any way, a Reconnect Permit shall be obtained from the Waupaca County Planning & Zoning Office.  Roll call vote was taken:  J. Penney—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Federwitz moved and R. Ellis seconded the motion to close the hearing at 10:15 a.m.  The motion was carried.

APPEARANCEScott Konkle, East Central Wisconsin Regional Planning Commission, gave an update on the Non-Metallic Mining Reclamation Budget and Program Review.  D. Federwitz moved and R. Ellis seconded the motion to CONTINUE the $35.00 per acre fee for the 2013 budget.   The motion was carried.

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – October 17, 2013

 

DISCUSSION AND POSSIBLE ACTION:

Ø  The Ad Hoc Non-Metallic Mining Ordinance Committee was discussed.  D. Federwitz moved and T. Murphy seconded the motion to APPROVE the Ad Hoc Non-Metallic Mining Ordinance committee members.   The motion was carried.

Ø  Ryan Brown, Planning & Zoning Director, presented an update on Farmland Preservation.

Ø  Telecommunication Tower Ordinance/Fee Schedule revisions were discussed and Ryan Brown, Planning & Zoning Director, presented a draft ordinance.

 

REVIEW:  Conditional Use Permit (CP-015-10) for Troy Dorschner located in Sec. 2, Caledonia for outdoor storage of motor vehicles.  The Committee APPROVED this review since the Planning & Zoning Office has not received any complaints.  This permit does not need to come back for any further review unless the Planning & Zoning Office receives a complaint.

The next Planning and Zoning Committee meeting has been scheduled for November 14, 2013.

 

T. Murphy moved and R. Ellis seconded the motion to adjourn the meeting at 10:25 a.m.  The motion was carried.
