WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –AUGUST 15, 2013

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Michael J. Sorenson property, Town of Helvetia, and the Dewaine Joseph Dixon property, Town of Helvetia.    

                           

Chm. Penney called the meeting to order at: 9:15 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

D. Kussmann moved and R. Ellis seconded the motion to approve the agenda as presented.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:19 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Michael J. Sorenson:  Located in Sec. 6, Town of Helvetia, lying along Aasen Road, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from a PVRF (Private Recreation and Forestry) District to an RR (Rural Residential) District to adjust a property line to accommodate the encroachment of an existing building and to alter the development rights for future residential purposes on approximately 21.83 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Michael Sorenson was sworn in to testify.  Mr. Sorenson said he would like to re-zone the property to correct an encroachment of the dwelling and to allow him development rights.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none.

 

Chm. Penney called three times for any testimony in opposition to the application.

 

David Herrmann was sworn in to testify.  Mr. Hermann said he owns a neighboring property and is in opposition of the application because of the number of development rights that the rezoning would create.

 

Jean Gliniecki, Zoning Administrator, explained the process for the development rights.  Development rights would require a subdivision plat.

 

Ryan Brown, Planning & Zoning Director, explained the rezone and how it relates to the Comprehensive Plan and that the development rights can be limited by the landowner’s request.  

 

Deb Giuffre read one (1) letter from the Town of Helvetia recommending approval of the application.

 

Michael J. Sorenson came back for rebuttal. Mr. Sorenson said that he would limit the development rights to one (1).

Jean Gliniecki, Zoning Administrator, gave a summary of the Petition for Zoning Map Amendment application request.

 

D. Kussmann moved and T. Murphy seconded the motion to GRANT the Petition for Zoning Map Amendment.  The Town of Helvetia Planning Commission and the Town Board of Helvetia approved this amendment and it is consistent with the Town’s Comprehensive Plan.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the zone change.  D. Federwitz moved and R. Ellis seconded the motion to close the hearing at 9:50 a.m.  The motion was carried.

The second public hearing was called to order at 9:51 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Dewaine Joseph Dixon:  Located in Sec. 16, Town of Helvetia, lying along Carper Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for the placement of a recreational vehicle intended for temporary living purposes in excess of  thirty (30) days in a PVRF (Private Recreation and Forestry) District on approximately 6.24 acres. The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Dewaine Dixon was sworn in to testify.  Mr. Dixon said the recreational vehicle has been in existence on the property for many years, and that he was unaware of the permitting process.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

Deb Giuffre read one (1) letter from the Town of Helvetia recommending approval of the application.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request.

 

T. Murphy moved and D. Federwitz seconded the motion to GRANT the application for Conditional Use Permit. The Town of Helvetia Planning Commission and the Town Board of Helvetia has recommended approval of this request and it is consistent with their Comprehensive Plan.  The following conditions MUST be met by the applicant: Have a County approved sanitary system.  Obtain a fire number for the property. Obtain a Land Use Permit for the roof over the recreational vehicle and the shed.  (After the fact permit fee = $150.00).  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  R. Ellis moved and D. Federwitz seconded the motion to close the hearing at 10:06 a.m.  The motion was carried.

 

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES –

August 15, 2013

 

APPEARANCES:

 

Ø  Eric Fowle, East Central Wisconsin Regional Planning Commission, discussed his 2013 Work Program and Activities Annual Report.

Ø  Scott Siegel, Siegel Auto & Recycling LLC appeared for a review on a Conditional Use Permit (CP-13-08) in Sec. 35, Town of Helvetia for a salvage yard.  The Planning & Zoning Committee decided to postpone the review until pending legal issues are resolved.

 

DISCUSSION AND POSSIBLE ACTION:

 

Ø  Resolution No. 17 to Apply for a Farmland Preservation Planning Grant.  D. Kussmann moved and T. Murphy seconded the motion to approve the Resolution and to recommend the resolution go to County Board for its approval.

Ø  Ryan Brown, Planning & Zoning Director presented the 2014 Budget.  D. Kussmann moved and R. Ellis seconded the motion to approve the 2014 Planning & Zoning budget and to forward it to the Finance Committee.  The Planning Department and Zoning Department budgets are going to be combined and once the office gets the final numbers from Heidi, the Committee will review them at its next meeting.

Ø  Resolution No. 18 to Amend Waupaca County Ordinance No. 45 of the General Code of Ordinances Comprehensive Plan Map.  D. Kussmann moved and T. Murphy seconded the motion to approve the Resolution and to recommend the resolution go to County Board for their approval.

Ø  Review a Conditional Use Permit (CP-009-10) for William S. Harris in Sec. 33, Town of Matteson for a structure to be used for human habitation that does not meet the twenty (22) foot minimum width requirement.  D. Federwitz moved and D. Kussmann seconded the motion to approve this review of the Conditional Use Permit and to have the Committee review it again in two (2) years.

The next Planning and Zoning Committee meeting has been scheduled for Tuesday, August 27, 2013.

 

D. Kussmann moved and R. Ellis seconded the motion to adjourn the meeting at 12:09 p.m.  The motion was carried.
