MINUTES –July 18, 2013

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Evon & Bonnie L. Olson property, Town of Helvetia; the Ronald Butzlaff property, Town of Helvetia and the Mark R. Rolfs property, Town of Lind.                              

 

Chm. Penney called the meeting to order at 10:00 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

 D. Kussmann moved and R. Ellis seconded the motion to approve the agenda as presented.  The motion was carried.

 

Public Comment: There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 10:03 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Evon & Bonnie L. Olson:  Located in part of the NE ¼ of the NW ¼ of Sec. 8, Town of Helvetia, lying along Pagel Road, Fire Number N9155, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Commercial Animal Facility (dog boarding & training) in a PVRF (Private Recreation and Forestry) District on approximately 40acres.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request.

 

Bonnie and Evon Olson were sworn in to testify.  Mrs. Olson said the proposed buyer of the property would like to operate a dog boarding and training facility, which requires a Conditional Use Permit.  Mrs. Olson read a letter from the proposed buyer explaining the business.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of Helvetia recommending approval of the application.

 

R. Ellis moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit application.   The Town of Helvetia Planning Commission and the Town Board of Helvetia recommended approval of this request and it is consistent with the Town’s Comprehensive Plan.  The following conditions MUST be met:  The existing mobile home shall be removed from the property prior to starting the commercial animal facility business: As stated in the proposed buyer’s letter to the Committee, the number of dogs would be limited to a maximum of 20 dogs.  Roll call vote was taken:  J. unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:21 a.m.  The motion was carried.

The second public hearing was called to order at 10:22 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Ronald Butzlaff:  Located in part of the SW ¼ of the SE ¼ and the South 10 acres of the NE ¼ of the SW ¼ and the South 10 acres of the NW ¼ of the SE ¼ of Sec. 29, Town of Helvetia, lying along Netzler Road, Fire Number N7802, Waupaca County, Wisconsin; for a Conditional Use Permit application for the placement of a recreational vehicle intended for temporary living purposes in excess of thirty (30) days in a PVRF (Private Recreation and Forestry) District on approximately 60 acres.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Jean Gliniecki, Zoning Administrator, gave a summary of the Conditional Use Permit application request.

 

Kevin and Brenda Kading were sworn in to testify.  Mr. Kading said he lives in Milwaukee and comes to the area on the weekends.  Mr. Kading said he is in the process of obtaining the property and would like to have a recreational vehicle on the property.  Mr. Kading said he intends to build a home on the property in the future.   

 

Leonard Oppor was sworn in to testify.  Mr. Oppor said he is the Chairman for the Town of Helvetia and the Town of Helvetia is in favor of the application with conditions.

Deb Giuffre read one (1) letter from the Town of Helvetia recommending approval of the application with conditions.

 

D. Federwitz moved and D. Kussmann seconded the motion to GRANT the application for                   Conditional Use Permit application. The Town of Helvetia Planning Commission and the Town Board of Helvetia recommended approval of this request with conditions and it is consistent with the Town’s Comprehensive Plan.   The following conditions MUST be met:  The junk/antique items around the recreational vehicle shall either be removed from the property or a storage building constructed to house those items within two (2) years from today’s date, which would be by July 18, 2015.  The recreational vehicle shall be removed from the property within two (2) years from today’s date, which would be by

July 18, 2015, in order for the applicant to construct a dwelling. Applicant shall have a County approved sanitary system on the property.  There shall be a culvert of at least 15” in the driveway.  There shall be a two (2) year review of this Conditional Use Permit by the Committee, which would be by July 18, 2015.   Roll call vote was taken:  J. permit.  R. Ellis moved and D. Federwitz seconded the motion to close the hearing at 11:06 a.m.  The motion was carried.

The third public hearing was called to order at 11:07 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Mark R. Rolfs:  Located in part of the NW ¼ of the SW ¼ of Sec. 30, Town of Lind, lying along County Highway E, Fire Number N658, Waupaca County, Wisconsin; for a Conditional Use Permit application for the construction of a Contractor Shop (landscaping) in an AWT (Agriculture and Woodland Transition) District on approximately 6.23 acres.   The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

Mark Rolfs was sworn in to testify.  Mr. Rolfs said he would like to construct a Contractor Shop for his landscaping business and also to store his equipment, which requires a Conditional Use Permit.

Deb Giuffre read two (2) letters, one (1) from the Town of Lind recommending approval of the application and one (1) from the County Highway Department with recommendations.

 

T. Murphy moved and R. Ellis seconded the motion to GRANT the application for Conditional Use Permit application.  The Town of Lind Planning Commission and the Town Board of Lind recommended approval of this request.  The following conditions MUST be met:  The recreational vehicle shall not be used for human habitation but may be stored on the property.  A Land Use Permit must be obtained from the Planning & Zoning Office prior to construction of the contractor shop/dwelling.  A Sanitary Permit must be obtained from the Planning & Zoning Office for the installation of a sanitary system.  A Building Permit must be obtained from the local Building Inspector prior to construction of the contractor shop/dwelling.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 11:16 a.m.  The motion was carried.

 

APPEARANCES:

 

Ø  Scott Siegel from Siegel Auto & Recycling LLC, for a review on a Conditional Use Permit (CP-13-08) in Sec. 35, Town of Helvetia for a salvage yard.  The Committee recommended that Jeff Henneman, Land Use/Code Enforcement Specialist, contact Jeff Siewert, Corporation Counsel, to discuss the fencing and buffer requirements and then put this issue back on the Committee’s agenda for further review.

DISCUSSION:

 

Ø  Ryan Brown, Planning & Zoning Director, discussed the Central Housing Consortium as it relates to the Planning & Zoning Department.

 

REVIEW:

 

Ø  David A. & Lori A. Derouso for a Conditional Use Permit (CP-006-10) in Sec. 17, Town of Union for the placement of a recreational vehicle intended for temporary living purposes in excess of 30 days.  The Committee has APPROVED this review since the Town of Union or the Planning & Zoning Office has not received any complaints.  This permit does not need to come back for any further review unless the Planning & Zoning Office receives a complaint.

 

 

The next Planning and Zoning Committee meeting has been scheduled for Thursday, August 1, 2013.
