MINUTES –July 9, 2013

 

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:30 a.m. on the Kermit W. & Delores E. Derozier property, Town of Matteson and the Mark Gaigg property, Town of Lebanon.                                    

 

Chm. Penney called the meeting to order at: 10:29 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

 D. Kussmann moved and R. Ellis seconded the motion to approve the agenda as presented.  The motion was carried.

 

R. Ellis moved and D. Federwitz seconded the motion to approve the minutes from the May 30, 2013 meeting.  The motion was carried.

 

Public Comment - There was none.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 10:31 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Kermit W. & Delores E. Derozier:  Located in part of the W ½ of the SW ¼ of the SE ¼ of Sec. 15, Town of Matteson, lying along Highway 156, Fire Number E11122, Waupaca County, Wisconsin; for a Conditional Use Permit application for the replacement of a structure to be used for human habitation that doesn't meet the 22 foot minimum width requirement in an AWT (Agriculture and Woodland Transition) District on approximately 20 acres. The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Kermit Derozier was sworn in to testify.  Mr. Derozier said he would like to replace the current mobile home with a newer model, and that the older mobile home would be tore down prior to the replacement.  Mr. Derozier said the Sanitary evaluation has been done.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

Deb Giuffre read one (1) letter from the Town of Lebanon recommending the approval of the application with conditions.

 

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for the             Conditional Use Permit. The Town of Matteson Planning Commission and the Town Board of Matteson have recommended approval of this request with conditions.  The following conditions MUST be met:  All unused appliances must be properly disposed.  Replacement mobile home and process must follow Town of Matteson Ordinance 3-97.  All unused tires must be properly disposed.   Current mobile

home must be moved or dismantled and removed from the Township immediately.   All junk cars must be removed and properly disposed.  Compliance of the above five conditions will be reviewed in one (1) year, which will be by July 9, 2014.  The existing sanitary system must be evaluated.  If the building sewer is altered in any way, a Reconnect Permit must be obtained from the Waupaca County Planning & Zoning Office.  A Land Use Permit must be obtained from the Waupaca County Planning & Zoning Office prior to the placement of the proposed mobile home.   The local Building Inspector must be contacted to see if a Building Permit is necessary prior to the placement of the proposed mobile home.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:43 a.m.  The motion was carried.

The second public hearing was called to order at 10:44 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Mark Gaigg:  Located in part of the SE ¼ of the SE ¼ of Sec. 07, Town of Lebanon, lying along Island Road, Fire Number E7740, Waupaca County, Wisconsin; for the extension of a Conditional Use Permit application for a structure to be used for human habitation that doesn't meet the 22 foot minimum width requirement in an AWT (Agriculture and Woodland Transition) District on approximately 10.20 acres.  The Committee, Ryan Brown, Planning & Zoning Director, and Jean Gliniecki, Zoning Administrator, made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Mark Gaigg was sworn in to testify.  Mr. Gaigg said he would like an extension of five (5) years to allow for the mobile home to remain on the property while he builds a home.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read three (3) letters, one (1) from the Town of Lebanon recommending the approval of the application with conditions, one (1) from the Veterans office recommending approval of the application and one (1) from an adjoining property owner with some concerns.

 

Mark Gaigg came back for rebuttal.  Mr. Gaigg said that prior to his financial difficulties he had plans for the home to be built and that a five (5) year extension would be sufficient for that to occur.

 

D. Federwitz moved and R. Ellis seconded the motion to GRANT the application for the Conditional Use Permit. The Town Board of Lebanon has recommended approval of this request to grant an extension of a minimum of three (3) years.  The following conditions MUST be met:  The Committee granted the extension of the Conditional Use Permit for a maximum of five (5) years and this permit will expire at the end of that five (5) year period, which will be by July 9, 2018.  The Committee will review this Conditional Use Permit in three (3) years, which will be by July 9, 2016.   If a dwelling is not constructed by the end of the five (5) year period (July 9, 2018), the existing mobile home must be removed from the

property.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  R. Ellis moved and D. Federwitz seconded the motion to close the hearing at 11:03 a.m.  The motion was carried.

The third public hearing was called to order at 11:04 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present  for the Selected Revisions to the Waupaca County Shoreland Zoning Ordinance, Waupaca County Code of Ordinances, Chapter 32, Waupaca County Zoning Ordinance, Waupaca County Code of Ordinances, Chapter 34;  Waupaca County Floodplain Ordinance, Waupaca County Code of Ordinances, Chapter 36 and the Waupaca County Subdivision Ordinance, Waupaca County Code of Ordinances, Chapter 37.  

 

Ryan Brown, Planning & Zoning Director, presented the proposed amendments to the Waupaca County Shoreland, Zoning, Floodplain and Subdivision Ordinances.

 

Kay Ellis was sworn in to testify.  Mrs. Ellis said she had some concerns with the mitigation plan of the
Shoreland Ordinance.  Mrs. Ellis also had suggestions for some word changes.

 

Patricia Craig was sworn in to testify.  Mrs. Craig said she had some concerns regarding the Subdivision Ordinance Sec. 8.07(3) Access, and public roads.

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from Amherst Land Surveying, LLC. regarding adjacent land owners and maximum lot sizes when combining parcels and doing sale/exchange of parcels.

 

Ryan Brown, Planning & Zoning Director addressed the concerns.

 

D. Kussmann moved and R. Ellis seconded the motion to APPROVE the Selected Revisions to the Waupaca County Shoreland Zoning Ordinance, Waupaca County Code of Ordinances, Chapter 32, Waupaca County Zoning Ordinance, Waupaca County Code of Ordinances, Chapter 34;  Waupaca County Floodplain Ordinance, Waupaca County Code of Ordinances, Chapter 36 and the Waupaca County Subdivision Ordinance, Waupaca County Code of Ordinances, Chapter 37 and recommend them to the Waupaca County Board for their approval at their July 16th meeting.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to approve the revisions.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 12:18 p.m.  The motion was carried.

 

 

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES –

July 9, 2013

 

 

REVIEW:

 

Thoe Family Irrevocable Trust for a Conditional Use Permit (CP-014-12) in Sec. 6, Town of Helvetia for exceeding the allowable number of animal units. The Committee APPROVED this review since the Planning & Zoning Office has not received any complaints.  This permit does not need to come back for any further review unless the Planning & Zoning Office receives a complaint.

 

 

The next Planning and Zoning Committee meeting has been scheduled for Thursday, July 18, 2013.
