MINUTES –May 30, 2013

 

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:15 a.m. on the Scott S. & Michelle Schroeder property, Town of Larrabee, Shirley Steingraber property, Town of Lebanon and J & E Faskell Family, LTD Partnership property, Town of Mukwa.                                 

 

Chm. Penney called the meeting to order at: 9:50 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

 D. Kussmann moved and R. Ellis seconded the motion to approve the agenda as presented.  The motion was carried.

 

D. Federwitz moved and R. Ellis seconded the motion to approve the minutes from the May 2, 2013 meeting.  The motion was carried.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:55 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Scott S. & Michelle Schroeder:  Located in part of the E ½ of the NE ¼ of Sec. 14, Town of Larrabee, lying along County Highway D, Fire Number N11172, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Major Home Occupation (Auto Detailing) in an AWT (Agriculture and Woodland Transition) District on approximately ten (10) acres.  The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Scott and Michelle Schroeder were sworn in to testify.  Mr. Schroeder said he would like to operate an automobile detailing business at his home, which requires a Conditional Use Permit application.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read three (3) letters, one from the Town of Larrabee recommending approval of the application, one from the County Highway Department with recommendations and one from a neighboring landowner in opposition to the application.

 

Scott and Michelle Schroeder came back for rebuttal.  Mr. Schroeder said that the complaint from the neighboring landowner was an isolated incident.

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for the Conditional Use Permit application. The Town of Larrabee Planning Commission and the Town Board of Larrabee were in favor of the application.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:10 a.m.  The motion was carried.

The second public hearing was called to order at 10:11 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Shirley Steingraber:  Located in part of the NW ¼ of the NW ¼ of Sec. 34, Town of Lebanon, lying along County Highway T, Fire Number E8515, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Mini-Warehouse in an AR (Agriculture Retention) District on approximately five (5) acres.  The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Jason and Kerrie Steingraber were sworn in to testify.  Mr. Steingraber said he would like to establish mini-warehouse business and it requires a Conditional Use Permit application.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application.

 

Kenneth Jacobchick was sworn in to testify.  Mr. Jacobchick said he has some concerns with the size of the business, increased traffic and noise.

 

Jason and Kerrie Steingraber came back for rebuttal.  Mr. Steingraber said he plans on only having six (6) to eight (8) mini-warehouses on five (5) acres.

 

Deb Giuffre read two (2) letters, one from the Town of Lebanon recommending approval of the application and one from the County Highway Department with recommendations.

 

T. Murphy moved and D. Federwitz seconded the motion to GRANT the application for Conditional Use Permit application.  The Town of Lebanon Planning Commission and the Town Board of Lebanon were in favor of the application.   The following conditions MUST be met:  The applicant shall be allowed to construct up to six (6) mini-warehouse buildings on the property, but any more than six (6) buildings will require another Conditional Use Permit; obtain a Land Use Permit from the Waupaca County Planning and Zoning Office prior to construction of the mini-warehouse; obtain a Building Permit from the local Building Inspector, prior to construction of the mini-warehouse.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:36 a.m.  The motion was carried.

 The third public hearing was called to order at 10:37 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for J & E Faskell Family, LTD Partnership:  Located in part of the NE ¼ of the SW ¼ of Sec. 7, Town of Mukwa, lying along Faskelll Road, Fire Number N4237, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Non-Metallic Mineral Extraction in an AWT (Agriculture and Woodland Transition) District on approximately four (4) acres.  The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

John Faskell was sworn in to testify.  Mr. Faskell said he is enhancing the pond on his property and hauling out material, which requires a Conditional Use Permit application.

 

Lee Shaw was sworn in to testify.  Mr. Shaw said he is a Supervisor for the Town of Mukwa and the Town of Mukwa is in favor of the application.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one (1) letter from the Town of Mukwa recommending approval of the application.

 

D. Federwitz moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit application.    The Town of Mukwa Planning Commission and the Town Board of Mukwa were in favor of the application.  The following conditions MUST be met:  Verify with Scott Konkle from East Central Wisconsin Regional Planning Commission to see if a permit for the restoration is necessary.  If a permit is necessary, the applicant must provide the Planning and Zoning Office with a copy of the permit. This project shall be completed within three (3) years, which would be by May 30, 2016.  If it is not completed by that time, the applicant must obtain another Conditional Use Permit in order to continue the project.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and D. Federwitz seconded the motion to close the hearing at 10:48 a.m.  The motion was carried.

 

 

APPEARANCES

 

Ø  Dave & Tina Neelis from Dave’s Sewer Service made an appearance concerning the Sanitary Maintenance Program.

Ø  Mike Koles for a discussion with the Committee.  Mr. Koles did not appear.

DISCUSS:

 

Ø  Ryan Brown, Planning & Zoning Director discussed the budget.

Ø  Jackie Beyer will be the interim Board of Adjustment member to replace Greg Blum who resigned from the Board of Adjustment.  Ms. Beyer will be appointed as a regular member of the Board of Adjustment at the June County Board meeting.

Ø  Add “Public Comment” to future agendas.

 

 

The next Planning and Zoning Committee meeting has been scheduled for Thursday, June 6, 2013.

 

D. Federwitz moved and R. Ellis seconded the motion to adjourn the meeting at 12:24 p.m.  The motion was carried.

 

The Committee adjourned.
