WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –May 2, 2013

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:15 a.m. on the Helen Petit, C/O Lunette Pohlman property, Town of Lebanon and Jeffrey E. Drath et al property, Town of Little Wolf.                                   

 

Chm. Penney called the meeting to order at: 9:34 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

 R. Ellis moved and T. Murphy seconded the motion to approve the agenda as presented.  The motion was carried.

 

R. Ellis moved and D. Federwitz seconded the motion to approve the minutes from the April 16, 2013 meeting.  The motion was carried.

 

RESOLUTION:

 

Resolution to Establish Public Participation Procedures to Amend the Waupaca County Comprehensive Plan.  D. Kussmann moved and T. Murphy seconded the motion to adopt the resolution as presented.  The motion was carried.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:41 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearings for the two Proposed Comprehensive Plan Amendments within the Towns of Lebanon and Little Wolf.   Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Les Prochnow was sworn in to testify.  Mr. Prochnow said he is the Chairman for the Town of Lebanon and the Town of Lebanon is in favor of the proposed Comprehensive Plan Amendment to allow RC-G (Rural Commercial-General) District to AWT (Agriculture and Woodland Transition) District for Agricultural use.

 

Jackie Beyer was sworn in to testify.  Ms. Beyer said she is the Clerk for the Town of Little Wolf and the Town of Little Wolf is in favor of the proposed Comprehensive Plan Amendment to amend the 37 acres from AE (Agriculture Enterprise) District to AR (Agriculture Retention) District in order for the property owner to build a house.   

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.                                                        

 

D. Kussmann moved and R. Ellis seconded the motion to APPROVE the Comprehensive Plan Amendment for the Town of Lebanon preferred land use classification from RC-G (Rural Commercial-General) District to AWT (Agriculture and Woodland Transition) District and the Town of Little Wolf

preferred land use classification from AE (Agriculture Enterprise) District to AR (Agriculture Retention).  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  R. Ellis moved and D. Kussmann seconded the motion to close the hearing at 9:51 a.m.  The motion was carried.

The second public hearing was called to order at 9:52 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Helen Petit, C/O Lunette Pohlman:  Located in Sec. 36, Town of Lebanon, lying along County Highway D, Fire Number N5071, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an RC-G (Rural Commercial-General) District to an AWT (Agriculture and Woodland Transition) District to be consistent with the Comprehensive Plan and the current use of the property on approximately 20.59 acres.  The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Lunette Pohlman was sworn in to testify.  Ms. Pohlman said she is the daughter of Helen Petit and that the current use of the property requires a zone change.

 

Les Prochnow was sworn in to testify.  Mr. Prochnow said he is the Chairman for the Town of Lebanon and the property was zoned RC-G (Rural Commercial-General) District during the Comprehensive Planning process and that the requested zone change to AWT (Agriculture and Woodland Transition) District is consistent with the current use.

Deb Giuffre read two letters, one from the Town of Lebanon recommending the approval of the application and one from the County Highway Department with comments regarding access. 

 

D. Federwitz moved and R. Ellis seconded the motion to GRANT the application for Petition for Zoning Map Amendment.   The Town of Lebanon Planning Commission and the Town Board of Lebanon approved this amendment and it is consistent with the Town’s Preferred Land Use Map.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:13 a.m.  The motion was carried.

 The third public hearing was called to order at 10:14 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Jeffrey E. Drath et al:  Located in Sec. 5, Town of Little Wolf, lying along White Clover Road, Fire Number N7155, Waupaca County,

Wisconsin; for a Petition for Zoning Map Amendment from an AE (Agriculture Enterprise) District to an AR (Agriculture Retention) District to be consistent with the Comprehensive Plan and for the construction of a dwelling on approximately 37 acres. The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Jeffrey Drath was sworn in to testify.  Mr. Drath said he would like to build a home on the property which would require a zone change for development rights.

R. Ellis moved and D. Kussmann seconded the motion to GRANT the application for Petition for Zoning Map Amendment.  The Town of Little Wolf Planning Commission and the Town Board of Little Wolf approved this amendment and it is consistent with the Town’s Preferred Land Use Map.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:23 a.m.  The motion was carried.

 

REVIEW:

 

Conditional Use Permit (CP-10-03) for Mich-Wis Pipe Line Co. & Sara Lee Corp. in Sec. 24, Town of Mukwa for a five-year review of a communication tower.  R. Ellis moved and T. Murphy seconded the motion to renew the permit for the communications tower for another five years and review it again at that time, which would be by May 2018.  The motion was carried.

D. Kussmann moved and R. Ellis seconded the motion to adjourn the meeting at 11:10 a.m.  The motion was carried.  The Committee adjourned.
