WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –MARCH 21, 2013

 

 

 

ON-SITE INSPECTION:  The Committee made an on-site inspection at 8:30 a.m. on the Union Threshermans Inc. property, Town of Union.                                                 

 

Chm. Penney called the meeting to order at: 9:30 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

D. Federwitz moved and D. Kussmann seconded the motion to approve the agenda as presented.  The motion was carried.

 

R. Ellis moved and T. Murphy seconded the motion to approve the minutes from the December 13, 2012 and the February 19, 2013 meeting.  The motion was carried.

 

 

PUBLIC HEARING:

 

The public hearing was called to order at 9:32 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Union Threshermans Inc:  Located in part of the SE ¼ of the NW ¼ of Sec. 34, Town of Union, lying along Highway 22, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Telecommunications Tower and Equipment Building in an AR (Agriculture Retention) District on approximately .23 acres.  The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Guy Stewart was sworn in to testify.  Mr. Stewart said he is the representative for SBA Communications and that SBA Communications would like to erect a tower and equipment building on the proposed site.  Mr. Stewart said that SBA Communications checked into co-locating on the two existing towers in the area, but the existing towers would not provide adequate coverage.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

Deb Giuffre read two letters, one from the Town of Union recommending approval of the application and one from the Department of Transportation approving the access.

 

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit application.  The Town Board of Union was in favor of the application and there was no opposition presented at the hearing.  The following conditions MUST be met: Be in accordance with all of the provisions in Section 11 – Telecommunication Towers, Antennas and Related Facilities of the Waupaca County Zoning Ordinance; obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the tower and equipment building; check to see if a Building Permit is necessary from the local Building Inspector prior to the construction.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  R. Ellis moved and D. Kussmann seconded the motion to close the hearing at 10:00 a.m.  The motion was carried.

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES –

March 21, 2013

               

DISCUSS

 

Ø  The contract payment to East Central Wisconsin Regional Planning Commission for the Coordinated Comprehensive Plan Amendment Process project was discussed.  D. Kussmann moved and R. Ellis seconded the motion to approve the payment for one-half ($2,500) of the contract amount of $5,000. The motion was carried.

Ø  Shoreland Advisory Committee/ Implementation Steering Committee’s process and roles were discussed.

Ø  Farmland Preservation statutes and alternate planning approach was explained.  Town Planning issues with the Comprehensive Plan and its implementation were discussed.  

Ø  Non-Metallic Mining Ordinance is in the process of being developed.

Ø  Floodplain Ordinance will be revised and updated.

Ø  Fee Schedule was reviewed.  D. Kussmann moved and D. Federwitz seconded the motion to approve a reduction in the fee for the Comprehensive Plan Amendment from $600.00 to $400.00 and a combination of a Comprehensive Plan Amendment and a Petition for Zoning Map Amendment to be $600.00.  The motion was carried.

Ø  Current planning is underway to create a junk cleanup program.

Ø  Purchase of Infield inspector tablets was discussed.

Ø  Audio System is available and will be utilized for the public hearings.

 

D. Kussmann moved and R. Ellis seconded the motion for the Committee to go into Closed Session.

 

CLOSED SESSION – Pursuant to WI State Statutes 19.85 (1) (c)

1.     Considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction.

 

D. Federwitz moved and D. Kussmann seconded the motion to adjourn the meeting at 12:07 p.m.  The motion was carried.
