MINUTES –January 10, 2013

 

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the James E. & Charlene E. Kratzke property, Town of Larabee, Kersten Holdings LLC property, Town of Larabee, John A. Gunnell Sr property, Town of Little Wolf and the Jerome J. & Lana Simonis property, Town of Royalton.                                              

 

Chm. Penney called the meeting to order at: 9:45 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

 R. Ellis moved and D. Kussmann seconded the motion to change the order of the agenda to 1) James E. & Charlene E. Kratzke, 2) Kersten Holdings LLC, 3) John A. Gunnell Sr, 4) Jerome J. & Lana Simonis and 5) Selected Revisions to:  The Waupaca County Zoning Ordinance Waupaca County Code of Ordinances, chapter 34; and the Waupaca County Subdivision Ordinance Waupaca County Code of Ordinances, chapter 37.  The motion was carried.

 

R. Ellis moved and D. Federwitz seconded the motion to approve the minutes from the November 1, 2012 and November 29, 2012 meetings.  The motion was carried.

 

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:53 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for James E. & Charlene E. Kratzke:  Located in part of the SE ¼ of the SE ¼ of Sec. 24, Town of Larrabee, lying north along Klemp Road, Waupaca County, Wisconsin; for a Petition for a Zoning Map Amendment from an SR-20 (Sewered Residential Single-Family) District to AWT (Agriculture and Woodland Transition) District to accommodate a land division involving parcel sizes that exceed the current zoning requirements on approximately 8.3 acres.  The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

 T. Murphy moved and R. Ellis seconded the motion to delay the James E. & Charlene E. Kratzke hearing until someone appeared at the meeting to testify on behalf of the request.

The second public hearing was called to order at 9:55 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Kersten Holdings LLC:  Located in part of the SE ¼ of the SE ¼ of Sec. 24, Town of Larrabee, lying south along Klemp Road, Waupaca County, Wisconsin; for a Petition for a Zoning Map Amendment from an SR-20 (Sewered Residential Single-Family) District to AWT (Agriculture and Woodland Transition) District on approximately 28.5 acres with a Conditional Use Permit application for a Non-Metallic Mineral Extraction on approximately 10 acres.   The Committee, Ryan Brown,

Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Toby L. Kersten was sworn in to testify.  Mr. Kersten said he would like to farm the land, which would require a zone change and he would also like to extract sand for bedding, which would require a Conditional Use Permit.

 

Chm. Penney called three times for any testimony in favor to the application.

 

Robert Hoffman was sworn in to testify.  Mr. Hoffman said he is the Supervisor for the Town of Larrabee and the Town of Larrabee is in favor of the Petition for Zoning Map Amendment and the Conditional Use Permit application.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read two letters and the minutes from the Town of Larrabee recommending approval of the Petition for Zoning Map Amendment and Conditional Use Permit application.

 

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for Petition for Zoning Map Amendment.  The Town Board of Larrabee approved this amendment and it is consistent with the Town’s Preferred Land Use Map.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  The motion was carried.

 

D. Federwitz moved and R. Ellis seconded the motion to GRANT the application for Conditional Use Permit.  The Town Board of Larrabee was in favor of the application and there was no opposition presented at the hearing.  The following conditions MUST be metProvide the Zoning Office with a copy of the permit for the restoration from East Central Wisconsin Regional Planning Commission. Project to be done according to the Reclamation Plan. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  R. Ellis moved and T. Murphy seconded the motion to close the hearing at 10:13 a.m.  The motion was carried.

 The third public hearing was called to order at 10:14 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for John A. Gunnell Sr:  Located in part of the SW ¼ of the NW ¼ of Sec. 10, Town of Little Wolf, lying along Fuhs Road, Fire Number E6110, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Long Term Outdoor Display and Sale (Used Vehicle Sales) in an RC-N (Rural Commercial-Neighborhood) District on approximately 1.863 acres.  The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

John Gunnell Sr was sworn in to testify.  Mr. Gunnell said that he is the owner of the property and that he would like to rent out space for used car sales, which requires a Conditional Use Permit.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application.  There was none.

 

Deb Giuffre read one letter and the minutes from the Town of Little Wolf recommending approval of the application.

 

R. Ellis moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit.  The Town Board of Little Wolf was in favor of the application and there was no opposition presented at the hearing.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and D. Federwitz seconded the motion to close the hearing at 10:24 a.m.  The motion was carried.

The fourth public hearing was called to order at 10:24 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Jerome J. & Lana Simonis:  Located on part of Lots 47-52 of the Plat of the Village of Royalton and also being in part of the SW ¼ of the NE ¼ of Sec. 1, Town of Royalton, lying along Highway 54, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an SR-20 (Sewered Residential Single-Family) District to an AWT (Agriculture and Woodland Transition) District to accommodate a land division involving parcel sizes that exceed the current zoning requirements on approximately 16 acres.   The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Jerome Simonis was sworn in to testify.  Mr. Simonis said that he would like to divide his land, but the current zoning does not allow the land division due to the parcel size.  A zone change is required.

 

Chm. Penney called three times for any testimony in favor to the application. 

 

Duane Bork was sworn in to testify.  Mr. Bork said he is Chairman for the Town of Royalton and the Town of Royalton is in favor of the application.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one letter from the Town of Royalton recommending approval of the application.

D. Federwitz moved and T. Murphy seconded the motion to GRANT the application for Petition for Zoning Map Amendment.   The Town Board of Royalton approved this amendment and it is consistent with the Town’s Preferred Land Use Map.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:35 a.m.  The motion was carried.

 

Chm. Penney called for anyone present for the James E. & Charlene E. Kratzke.  There was no one present.

 

Jean Gliniecki, Zoning Administrator explained that Mr. Kratzke was out of Town and misunderstood that he needed to appear for the hearing.  Ms. Gliniecki explained the Petition for Zoning Map Amendment request.

The Committee decided to allow Jean Gliniecki, Zoning Administrator to testify on behalf of the Petition for Zoning Map Amendment request for James E. & Charlene E. Kratzke.  The hearing was called to order at 10:37 a.m. by Chm. Penney.  The persons notified of the hearing had previously been read.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing

 

Jean Gliniecki, Zoning Administrator.  Ms. Gliniecki said that a Petition for Zoning Map Amendment was required to allow for the land division.  The current zoning district has a maximum lot size of one acre and the proposed land division will be creating two lots exceeding the maximum lot size in each parcel.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one letter from the Town of Larrabee recommending approval of the application.

 

T. Murphy moved and D. Kussmann seconded the motion to GRANT the application for Petition for Zoning Map Amendment.  The Town Board of Larrabee approved this amendment and it is consistent with the Town’s Preferred Land Use Map.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:43 a.m.  The motion was carried.

Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Selected Revisions to:  The Waupaca County Zoning Ordinance Waupaca County Code of Ordinances, Chapter 34; and the Waupaca County Subdivision Ordinance Waupaca County Code of Ordinances, Chapter 37.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

 

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES –

January 10, 2012

 

Ryan Brown, Planning & Zoning Director presented the proposed amendments to the Waupaca County Zoning and Subdivision Ordinances.

 

K. Ellis was sworn in to testify.  Ms. Ellis said the Rural Crossroad Mixed use category needed to be clarified to the Hamlet District.  Ms. Ellis said that under (3.10), (3.11) the SR-10 (Sewered Residential Single-Family) District and the SR-20 (Sewered Residential Single-Family) Districts allow two-family residences as a Conditional Use Permit.  Ms. Ellis said that two-family residences should be under the Multiple Family Residence category. 

 

Les Prochnow was sworn in to testify.  Mr. Prochnow said he is the Chairman for the Town of Lebanon and asked for clarification of access, easements and road right of way.

 

Wayne Reuter was sworn in to testify.  Mr. Reuter said he is a land surveyor and works for Nordin and Associates.  Mr. Reuter had questions on (7.03) of the Subdivision Ordinance regarding the use of the Coordinate System, (7.04) Dedication requirements, forty-acre parcels and road right of way.

 

Mike Haynes was sworn in to testify.  Mr. Haynes said he is the owner of Haynes Surveying.  Mr. Haynes discussed the (7.04) Dedication requirements and (7.03) Coordinate System.

 

Kyle Fischer was sworn in to testify.  Mr. Fischer said he is a land surveyor with Riverside Land Surveying.  Mr. Fischer discussed road dedication and access requirements.

 

Steve Paulson was sworn in to testify.  Mr. Paulson said he had questions regarding campground regulations and time frame.

 

Arden Adamson was sworn in to testify.  Mr. Adamson said he is the owner of land and that the current zoning does not allow for mini warehouse storage.  Revisions to the Waupaca County Zoning Ordinance will allow this use.  Mr. Adamson wanted to know the effective date of the revisions after adoption.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

D. Federwitz moved and R. Ellis seconded the motion to APPROVE the Selected Revisions to the Waupaca County Zoning Ordinance Waupaca County Code of Ordinances, Chapter 34; and the Waupaca County Subdivision Ordinance Waupaca County Code of Ordinances, Chapter 37 and recommend them to the Waupaca County Board for their approval at their February 19th meeting.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to approve the revisions.  D. Federwitz moved and T. Murphy seconded the motion to close the hearing at 11:56 a.m.  The motion was carried.

 

 

 

 

 

 

 

DISCUSSION:

 

Ø   Ryan Brown, Planning & Zoning Director discussed issues concerning: Maximum lot sizes, densities and future Preferred Land Use Maps.

 

 

D. Kussmann moved and R. Ellis seconded the motion to adjourn the meeting at 12:13 p.m.  The motion was carried.  The Committee adjourned.
