WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –December 13, 2012

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Daniel M. & Kari S. O’Brien, Town of Waupaca and Richard K. Peterson, Town of Royalton.                                           

 

Chm. Penney called the meeting to order at: 9:45 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

 D. Kussmann moved and R. Ellis seconded the motion to approve the agenda with the exception of the appearance of Scott Bestul being omitted.  The motion was carried.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:48 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Daniel M. & Kari S. O’Brien:  Located in part of the SE ¼ of the SW ¼ of Sec. 6, Town of Waupaca, lying along Elm Valley Rd, Fire Number N4553, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Minor Indoor Institutional (Church) in an AWT (Agriculture and Woodland Transition) District on approximately 5 acres. The Committee, Ryan Brown, Planning & Zoning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Steve Aberg was sworn in to testify.  Mr. Aberg said he is the representative for the proposed Gateway Apostolic Church and he would like to purchase the property and establish a church, which requires a Conditional Use Permit application.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none.

 

Chm. Penney called three times for any testimony in opposition to the application.

 

Cindy Gutknecht was sworn in to testify.  Ms. Gutknecht said that she owns property nearby and has some concerns with the property taxes being increased and the road wear.

 

Steve Aberg came back for rebuttal.  Mr. Aberg said that the proposed church and purchase of the property is contingent on the Conditional Use Permit application being granted.

 

Deb Giuffre read one letter from the Town of Waupaca recommending the approval of the application.

 

D. Federwitz moved and R. Ellis seconded the motion to GRANT the application for Conditional Use Permit application.  The Town Board of Waupaca was in favor of the applicationThe following conditions MUST be met:  Obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the church; obtain a Building Permit from the Commercial Building Inspector prior to the construction of the church. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Federwitz moved and R. Ellis seconded the motion to close the hearing at 10:10 a.m.  The motion was carried.

The second public hearing was called to order at 10:11 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Richard K. Peterson:  Located in part of the NE ¼ of the NE ¼ of Sec. 19, Town of Royalton, lying along Highway 54, Fire Number E5251, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Telecommunications Tower and Equipment Building in an AWT (Agriculture and Woodland Transition) District on approximately 31.55 acres.. The Committee, Ryan Brown, Planning Director and Jean Gliniecki, Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Guy Stewart was sworn in to testify.  Mr. Stewart said he is the representative for Verizon Wireless and that Verizon Wireless would like to erect a tower and equipment building on the proposed site.  Mr. Stewart said that Verizon Wireless checked into co-locating on existing towers in the area, but the existing towers would not provide adequate coverage.

Deb Giuffre read one letter from the Town of Royalton recommending the approval of the application.

 

D. Federwitz moved and R. Ellis seconded the motion to GRANT the application for Conditional Use Permit application.  The Town Board of Royalton was in favor of the application and there was no opposition presented at the hearing.  The following conditions MUST be met: Be in accordance with all of the other provisions in Section 11 – Telecommunication Towers, Antennas and Related Facilities of the Waupaca County Zoning Ordinance; obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the tower and equipment building; check to see if a Building Permit is necessary from the local Building Inspector prior to the construction.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:28 a.m.  The motion was carried.

 

 

APPEARANCES: 

 

Ø  Scott Konkle, East Central Wisconsin Regional Planning Commission, gave an update on the Reclamation Program Budget and Program Review.  D. Federwitz moved and R. Ellis seconded the motion to CONTINUE the $35.00 per acre fee for the 2013 budget.   The motion was carried.

 

Ø  Eric Fowle, East Central Wisconsin Regional Planning Commission, discussed the Contract for Professional Services between the ECWRPC and Waupaca County for the development of a coordinated Comprehensive Plan Amendment Process.

 

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – December 13, 2012

 

DISCUSS:

 

Ø   Iola Conservation Club; The Committee discussed the improvements that have been made to the shooting range.  The Planning & Zoning Committee approved these improvements and felt that the safety regulations were met.  The Committee is requiring that the Iola Conservation Club provide written documentation from the Waupaca County Sheriff’s Department.

 

Ø  Land Use/Code Enforcement Specialist position.  Through the Classification and Compensation Study by Carlson Dettmann Consulting, it was suggested this position go to an hourly 40 hours per week position.  The Committee approved this recommendation.

 

Ø  Proposed amendments to the Waupaca County Zoning and Subdivision Ordinances.  The public hearing for the proposed revisions will be held on January 10, 2013 and tentatively will go to the County Board for approval at their February meeting.

 

Ø  Farmland Preservation Zoning District.  Discussion on non-metallic mining being a Conditional Use Permit in the Farmland Preservation Zoning District.

 

 

The next Planning and Zoning Committee meeting has been scheduled for January 10, 2013.
