WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –November 29, 2012                                              

 

Chm. Penney called the meeting to order at: 1:30 p.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

D. Kussmann moved and D. Federwitz seconded the motion to approve the agenda as presented.  The motion was carried.

 

R. Ellis moved and D. Federwitz seconded the motion to approve the minutes from the October 18, 2012 meeting.  The motion was carried.

 

PLANNING & ZONING COMMITTEE DECISION:

 

The Planning & Zoning Committee meeting was called to order at 1:32 p.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Decision on the following application: Gerald A. & Susan M. Tellock and Roger E. & Geraldine Henschel:  Located in Sec. 13, Town of Union, lying along Dennison Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Non-Metallic Mineral Extraction in an AE (Agriculture Enterprise) District on approximately 160 acres. 

 

Attorney Richard Carlson, representative for Waupaca County.  Mr. Carlson explained the Conditional Use Permit process and how it relates to the Zoning Ordinance and Comprehensive Plan.  

 

Ryan Brown, Planning & Zoning Director.  Mr. Brown gave an overview of the facts surrounding the application at the Planning & Zoning Committees request.  

 

Planning & Zoning Committee.  The Planning & Zoning Committee discussed  concerns regarding the proposed sand mine and the Town of Union's Comprehensive Plan  as it refers to mineral extraction operations or the operation of equipment within 2000 feet of existing, non-farm residences. 

 

D. Federwitz moved and T. Murphy seconded the motion to POSTPONE the decision and remand the application for Conditional Use back to the Town of Union.  The Town of Union Year 2030 Comprehensive Plan (LU9) states “Conditional use permits for new mineral extraction operations shall not permit extraction operations or the operation of equipment within 2000 feet of existing, non-farm residences.”   The Planning & Zoning Committee would like the Town of Union to clarify the 2000 feet. The Committee recommends that the Town of Union Planning Commission and the Town Board of Union re-evaluate their recommendation for the Conditional Use Permit based on the clarification of the Town’s Comprehensive Plan. Once the Town notifies the County of their clarification, this Conditional Use Permit application will come back to the Planning & Zoning Committee for their decision. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to postpone the decision on the Conditional Use Permit.  The motion was carried.

 

D. Kussmann moved and R. Ellis seconded the motion to adjourn the meeting at 2:30 p.m.  The motion was carried.  The Committee adjourned.
