WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –August 30, 2012

 

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:30 a.m. on the Theodore J. Jr & Sharon Bouchette property, Town of Matteson and the William Dugenske property, Town of Waupaca.                                                

 

Chm. Penney called the meeting to order at: 10:02 a.m. with the following members present J. Penney, D. Kussmann, R. Ellis and D. Federwitz, present. T. Murphy was excused.

 

 R. Ellis moved and D. Federwitz seconded the motion to approve the agenda as presented.  The motion was carried.

 

D. Kussmann moved and D. Federwitz seconded the motion to approve the minutes from the August 2, 2012 meeting.  The motion was carried.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 10:04 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, R. Ellis and D. Federwitz, present. T. Murphy was excused.  Deb Giuffre read the names of persons notified of the hearing for Theodore J. Jr & Sharon Bouchette:  Located in part of the S ½ of the SE ¼ of the SW ¼ of Sec. 8, Town of Matteson, lying along County Highway Y, Fire Number N11325, Waupaca County, Wisconsin; for a Conditional Use Permit application for the construction of a customary residential accessory structure in an RC-N (Rural Commercial-Neighborhood) District on approximately 20 acre The Committee and Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Theodore Bouchette was sworn in to testify.  Mr. Bouchette said he would like to replace an existing garage with a new one but due to the current zoning of the property it requires a Conditional Use Permit.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read two letters one from the Town of Matteson recommending approval of the application and one from the Waupaca County Highway Department with comments.

 

 D. Federwitz moved and R. Ellis seconded the motion to GRANT the application for Conditional Use Permit application.  The Town Board of Matteson was in favor of the application and there was no opposition presented at the hearing.  The following conditions MUST be met: Obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the accessory structure.   Check to see if a Building Permit is necessary from the local Building Inspector prior to the construction of the accessory structure.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and D. Federwitz—yes, unanimous vote to grant the permit.  The motion was carried.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:15 a.m.  The motion was carried.

The second public hearing was called to order at 10:16 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, R. Ellis and D. Federwitz, present. T. Murphy was excused.  Deb Giuffre read the names of persons notified of the hearing for William Dugenske:  Located in part of the S ½ of the NW ¼ of Sec. 7, Town of Waupaca, lying along White Tail Trail, Fire Number E2513, Waupaca County, Wisconsin; for a Conditional Use Permit application for an addition to a Substantial Residential Accessory Structure in an AWT (Agriculture and Woodland Transition) District on approximately 5 acres.   The Committee and Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

William Dugenske was sworn in to testify.  Mr. Dugenske said he would like to put an addition onto an existing accessory structure for storage which would require a Conditional Use Permit for a Substantial Structure.

 

Chm. Penney called three times for any testimony in favor to the application.

 

Michael Orr was sworn in to testify.  Mr. Orr said he is the Chairman for the Town of Waupaca and the Town of Waupaca is in favor of the application.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one letter from the Town of Waupaca recommending approval of the application.

 

D. Kussmann moved and R. Ellis seconded the motion to GRANT the application for Conditional Use Permit application.  The Town Board of Waupaca was in favor of the application and there was no opposition presented at the hearing.  The following conditions MUST be met:  Obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the addition to the accessory structure. Kussmann seconded the motion to close the hearing at 10:25 a.m.  The motion was carried.

 The third continuation public hearing was called to order at 10:27 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, R. Ellis and D. Federwitz, present. T. Murphy was excused.  Deb Giuffre read the names of persons notified of the hearing for Robert L. & Mary Beatty Roloff:  Located in part of the SW ¼ of the SE ¼ and also being in part of the SE ¼ of the SE ¼ of Sec 26, Town of Farmington, lying along County Highway QQ, Fire Number N2919, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Minor Indoor Institutional (Holistic Clinic) in an SR-20 (Sewered Residential Single-Family) District on approximately .93 acres.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

Mary Beatty Roloff was sworn in to testify.  Mrs. Roloff said she would like to move and expand her existing Holistic Clinic which requires a Conditional Use Permit.

 

Chm. Penney called three times for any testimony in favor to the application.

 

Dale Trinrud was sworn in to testify.  Mr. Trinrud said he is the Chairman for the Town of Farmington and the Town of Farmington is in favor of the application.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one letter from the Town of Farmington recommending approval of the application.

 

D. Federwitz moved and R. Ellis seconded the motion to GRANT the application for the Conditional Use Permit application.  The Town Board of Farmington was in favor of the application and there was no opposition presented at the hearing.  The following conditions MUST be met:  Have the existing sanitary system evaluated to make sure that it is functioning properly. Check to see if a Building Permit is necessary from the Commercial Building Inspector prior to any remodeling of the structure. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and D. Federwitz—yes, unanimous vote to grant the permit.  The motion was carried.  R. Ellis moved and D. Kussmann seconded the motion to close the hearing at 10:36 a.m.  The motion was carried.

 

 

 

The next Planning and Zoning Committee meeting has been scheduled for September 20, 2012.
