WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –August 16, 2012

 

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 7:30 a.m. on the Donald J. Brown property, Town of Little Wolf, Robert L. & Mary Beatty Roloff property, Town of Farmington and the 10K Enterprises LLC property, Town of Farmington.                                                  

 

Chm. Penney called the meeting to order at: 9:00 a.m. with the following members present:  J. Penney, D. Kussmann, R. Ellis and D. Federwitz, present. T. Murphy was excused.

 

 D. Federwitz moved and D. Kussmann seconded the motion to approve the agenda as presented.  The motion was carried.

 

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:02 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, R. Ellis and D. Federwitz, present. T. Murphy was excused. Deb Giuffre read the names of persons notified of the hearing for the Proposed Comprehensive Plan Amendment.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Lauritzen Properties LLC:  Located in part of the NW ¼ of the NE ¼ of Sec. 29, Town of Dayton, lying along Hwy 22, Waupaca County, Wisconsin; for a County Comprehensive Plan Amendment from an AWT (Agriculture and Woodland Transition) Preferred Land Use Classification to an RC-I (Rural Commercial -Industrial) Preferred Land Use Classification for an expansion to the L & L propane business on approximately 2.13 acres. 

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

D. Federwitz moved and R. Ellis seconded the motion to GRANT the application for the County Comprehensive Plan AmendmentRoll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and D. Federwitz—yes, unanimous vote to grant the amendment.  The motion was carried.

 

Donald J. Brown :  Located in part of the NW ¼ of the NE ¼ and also being in part of the SW ¼ of the NE ¼ of Sec.15, Town of Little Wolf , lying along Pond Street, Fire Number N6410, Waupaca County, Wisconsin; for a County Comprehensive Plan Amendment from an AE (Agriculture Enterprise)/ AUI ( Agriculture/Urban Interface) Preferred Land Use Classification to UT (Urban Transition) Preferred Land Use Classification to accommodate a boundary line adjustment between two adjoining parcels on approximately .77 acres.

D. Kussmann moved and R. Ellis seconded the motion to GRANT the application for the County Comprehensive Plan AmendmentRoll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and D. Federwitz—yes, unanimous vote to grant the amendment.  The motion was carried.

 

Maynard & Catherine D. Sordahl:  Located in part of the SW ¼ of the SW ¼ of Sec. 21, Town of Little Wolf, lying along County Highway B, Waupaca County, Wisconsin; for a County Comprehensive Plan Amendment from an AE (Agriculture Enterprise) Preferred Land Use Classification to an RC-N (Rural Commercial - Neighborhood) Preferred Land Use Classification for the sale of the property for commercial use on approximately 4.966 acres.

R. Ellis moved and D. Federwitz seconded the motion to GRANT the application for the County Comprehensive Plan AmendmentRoll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and D. Federwitz—yes, unanimous vote to grant the amendment.  The motion was carried.

                                                                                                                             

Michael R & Mary Jo Krueger:  Located in part of the S ½ of the NE ¼, lying east of the highway in Sec. 17, Town of Matteson, Fire Number N11099, lying along Palmer Road, Waupaca County, Wisconsin; for a County Comprehensive Plan Amendment from an AE (Agriculture Enterprise) Preferred Land Use Classification to an AWT (Agriculture and Woodland Transition) Preferred Land Use Classification for residential purposes on approximately 40 acres. 

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

D. Kussmann moved and R. Ellis seconded the motion to GRANT the application for the County Comprehensive Plan AmendmentRoll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and D. Federwitz—yes, unanimous vote to grant the amendment.  The motion was carried.

 

Raymond & Karen Pagel:  Located in part of the NW ¼ of the SW ¼ of Sec. 18, Town of Weyauwega, Fire Number E4994, lying along Little River Rd, Waupaca County, Wisconsin; for a County Comprehensive Plan Amendment from an AR (Agriculture Retention) Preferred Land Use Classification to an RC-I (Rural Commercial - Industrial) Preferred Land Use Classification for a indoor maintenance service, (auto repair and body shop) on approximately 1 acre.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

D. Federwitz moved and D. Kussmann seconded the motion to GRANT the application for the County Comprehensive Plan AmendmentRoll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and D. Federwitz—yes, unanimous vote to grant the amendment.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 9:16 a.m.  The motion was carried.

The second public hearing was called to order at 9:17 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, R. Ellis and D. Federwitz, present. T. Murphy was excused. Deb Giuffre read the names of persons notified of the hearing for Donald J. Brown:  Located in part of the NW ¼ of the NE ¼ and also being in part of the SW ¼ of the NE ¼ of Sec.15, Town of Little Wolf , lying along Pond Street, Fire Number N6410, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an AE (Agriculture Enterprise) District to RR (Rural Residential) District to accommodate a boundary line adjustment between two adjoining parcels, one being in an RR (Rural Residential) District and one being in an AE (Agriculture Enterprise) District on approximately .77 acres. 

The Committee and Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Linda Hayes was sworn in to testify.  Mrs. Hayes said she is the representative for Mr. Brown.  Mrs. Hayes said that she purchased adjoining property from Mr. Brown to construct a garage and the property is zoned AE (Agriculture Enterprise). 

 

Nancy Erickson was sworn in to testify.  Mrs. Erickson said that she owns neighboring property and has no objections to the zone change.

 

 Jackie Beyer was sworn in to testify. Mrs. Beyer said she is the Clerk for the Town of Little Wolf and the Town is in favor of the Zoning Map Amendment.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one letter from the Town of Little Wolf recommending approval of the application.

 

D. Federwitz moved and D. Kussmann seconded the motion to GRANT the application for Petition for Zoning Map Amendment.   The Town Board of Little Wolf approved this amendment and it is consistent with the Town’s Preferred Land Use Plan.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and D. Federwitz——yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 9:25 a.m.  The motion was carried.

 The third public hearing was called to order at 9:26 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, R. Ellis and D. Federwitz, present. T. Murphy was excused.  Deb Giuffre read the names of persons notified of the hearing for Robert L. & Mary Beatty Roloff:  Located in part of the SW ¼ of the SE ¼ and also being in part of the SE ¼ of the SE ¼ of Sec 26, Town of Farmington, lying along County Highway QQ, Fire Number N2919, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Minor Indoor Institutional (Holistic Clinic) in an SR-20 (Sewered Residential Single-Family) District on approximately .93 acres.  The Committee and Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

D. Kussmann moved and R. Ellis seconded the motion to CONTINUE the application for Conditional Use Permit.  The applicant did not appear at the Public Hearing and the Planning & Zoning Committee wanted to be able to listen to the testimony. This public hearing will be continued at the next Planning & Zoning Committee meeting scheduled for August 30, 2012.  The Committee may be making their decision at that time.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and D. Federwitz—yes, unanimous vote to grant the permit.  D. Kussmann moved and D. Federwitz seconded the motion to close the hearing at 9:28 a.m.  The motion was carried.

The fourth public hearing was called to order at 9:36 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, R. Ellis and D. Federwitz, present. T. Murphy was excused.  Deb Giuffre read the names of persons notified of the hearing for 10K Enterprises LLC:  Located in part of the S ½ of the NE ¼ and also being in part of Government Lot #2 of Sec. 28, Town of Farmington, lying along Silver Lake Drive, Fire Number N3117, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an RC-N (Rural Commercial - Neighborhood) District to an SR-M (Sewered Residential Multi-Family) District to be consistent with the current use and with the Comprehensive Plan on approximately 2.12 acres.  The Committee and Zoning Administrator made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Janice Barnhart was sworn in to testify.  Mrs. Barnhart said she would like to convert the existing offices into apartments and to rezone the property to comply with the current use. 

 

Dale Trinrud was sworn in to testify.  Mr. Trinrud said he is the Chairman for the Town of Farmington and the Town of Farmington is in favor of the Petition for Zoning Map Amendment. 

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one letter from the Town of Farmington recommending approval of the application.

 

R. Ellis moved and D. Federwitz seconded the motion to GRANT the application for Petition for Zoning Map Amendment.  The Town Board of Farmington approved this amendment and it is consistent with the Town’s Preferred Land Use Plan. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and D. Federwitz—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 9:43 a.m.  The motion was carried.

 

 

 

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – August 16, 2012

 

REVIEW:

 

 

Ø Raul Erickson et al in Sec. 17, Town of Union for a Conditional Use Permit (CP-013-09) for the placement of a recreational vehicle intended for temporary living purposes in excess of 30 days. D. Kussmann moved and D. Federwitz seconded the motion APPROVE this review and unless the Planning and Zoning Office receives any complaints, this permit does not need to come back for any further review. The motion was carried.

 

Ø  2013 Budget was reviewed by the Planning and Zoning Committee.  D. Kussmann moved and R. Ellis seconded the motion to approve the 2013 budget.  The motion was carried.

 

 

The next Planning and Zoning Committee meeting has been scheduled for August 30, 2012.
