WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –June 14, 2012

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Jason L. & Tara L. Moder property, Town of Bear Creek and the Thoe Family Irrev Trust property, Town of Helvetia.                                               

 

Chm. Penney called the meeting to order at: 9:34 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

 D. Kussmann moved and R. Ellis seconded the motion to approve the agenda as presented.  The motion was carried.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 9:36 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Jason L. & Tara L. Moder:  Located in part of the SW ¼ of the NW ¼ and the NW ¼ of the SW ¼ of Sec. 13, Town of Bear Creek, lying along Highway 45, Waupaca County, Wisconsin; for a Conditional Use Permit application for the construction of a Single Family Residence in an AE (Agriculture Enterprise) District on approximately 13.52 acres.  The Committee and Jean Gliniecki made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Tara Moder was sworn in to testify.  Mrs. Moder said she would like to build a home, but the current zoning on the property requires a conditional use permit.  Mrs. Moder said that the access has been approved by the Department of Transportation and the Sanitary Permit has been issued. 

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one letter from the Town of Bear Creek recommending approval of the application.

 

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit. The Town of Bear Creek was in favor of the application and there was no opposition presented at the hearing.  The following conditions MUST be met:  obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the dwelling; obtain a Sanitary Permit from the Planning & Zoning Office for the installation of the sanitary system; obtain a Building Permit from the local Building Inspector prior to the construction of the dwelling. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 9:43 a.m.  The motion was carried.

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – June 14, 2012

                                                         

The second public hearing was called to order at 9:45 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the names of persons notified of the hearing for Thoe Family Irrev Trust:  Located in part of the SW ¼ of the NW ¼ of Sec. 6, Town of Helvetia, lying along County Highway G, Fire Number E2592, Waupaca County, Wisconsin; for a Conditional Use Permit application to exceed the allowable number of animal units in an RR (Rural Residential) District and an RP (Resource Protection) District on approximately five acres.   The Committee and Jean Gliniecki made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Larry Thoe was sworn in to testify.  Mr. Thoe said he is the owner of the property.  Mr. Thoe said that with the new zoning regulations the number of animals is limited per acre.  Mr. Thoe said that the current residents would like to purchase the property, but own a purebred horse business.

 

Chm. Penney called three times for any testimony in favor to the application.

 

Lee DeLeon was sworn in to testify.  Mrs. DeLeon said her daughter is the current resident and is the owner of the horse business. Mrs. DeLeon said that the horses are purebred and champion show horses.  Mrs. DeLeon said that they have six to eight broodmares and the offspring are sold.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read three letters one from the Town of Helvetia recommending approval of the application, one from the residents of the property and one from a landowner opposed to the application.

 

T. Murphy moved and R. Ellis seconded the motion to GRANT the application for Conditional Use Permit. The Town of Helvetia was in favor of the application.  The following conditions MUST be met:  Not to exceed 6 – 8 broodmares on the property at any one time. The Committee will be reviewing this permit in one (1) year from today’s date, which would be by June 14, 2013. The manure SHALL be removed from the property on a regular basis. This Conditional Use Permit may transfer with the sale of the property one time.  Any new owners of the property after that will be required to obtain another Conditional Use Permit to continue this use. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  R. Ellis moved and D. Federwitz seconded the motion to close the hearing at 10:26 a.m.  The motion was carried.

 

 

DISCUSSION

 

Ø  Sanitary Maintenance Notice fee and possible late fee was discussed by the Committee.  D. Federwitz moved and D. Kussmann seconded the motion to approve a Notice fee of thirty- five dollars and to review in (1) year. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to approve the Notice fee.

Ø  Comprehensive Plan review fees were discussed. The Committee agreed to waive the individual application fee for the upcoming amendment to the Waupaca County Comprehensive Plan. The Committee determined that given the number of map amendments, cost for an individual application was minimal and did not warrant the comprehensive plan amendment application fee.

The Committee agreed that this was due to unique nature of the upcoming amendment, and future applications for comprehensive plan amendments would be charged the established fee.

Ø  Public Participation Procedures to Amend the Waupaca County Comprehensive Plan.  D. Federwitz moved and R. Ellis seconded the motion to approve the public participation plan to amend the Waupaca County Comprehensive Plan and forward to the County Board.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to approve to amend the Waupaca County Comprehensive Plan and forward to the County Board.

Ø  Appointments to the Farmland Preservation Steering Committee were presented by Melinda Osterberg.  D. Federwitz moved and R. Ellis seconded the motion to recommend appointments to the County Board for approval. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to recommend appointments to the County Board.

Ø  Discuss the County Planner position.  The Committee determined that no action was necessary regarding this item.

Ø  Letter from Bob Myers concerning property in the Town of Waupaca.  A release of liability letter was signed by Mr. Myers.  D. Kussmann moved and R. Ellis seconded the motion to accept the release of liability letter.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—no and T. Murphy—yes, four to one vote to accept the release of liability letter.

 

 

The next Planning and Zoning Committee meeting has been scheduled for July 12, 2012.
