WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING

MINUTES –March 22, 2012

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:00 a.m. on the Dominico G & Nancy A Piccolo Family Trust property, Town of Matteson , Steven A & Sue Ann Goedderz property, Town of Lebanon, Todd & Sheila Zielke, Town of Little Wolf, and the Kenneth & Diane Winske property, Town of Lind.

                                                  

Chm. Penney called the meeting to order at: 10:12 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.

 

 D. Kussmann moved and R. Ellis seconded the motion to change the order of the agenda to 1) Dominico G & Nancy A Piccolo Family Trust 2) Todd & Sheila Zielke 3) Kenneth & Diane Winske and 4) Steven A & Sue Ann Goedderz.  The motion was carried.

 

R. Ellis moved and T. Murphy seconded the motion to approve the minutes from the February 9 and February 23, 2012 meetings.  The motion was carried.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 10:16 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the notice as it appeared in the paper and the names of persons notified of the hearing for Dominico G & Nancy A Piccolo Family Trust located in Sec. 22, Town of Matteson, Fire Number N11131, lying off from Cass Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for Non-Metallic Mineral Extraction in an AR (Agriculture Retention) District on approximately 1 acre. The Committee and Jean Gliniecki made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

D. Federwitz was sworn in to testify.  Mr. Federwitz said due to an illness the applicant's agent was unable to attend.  Mr. Federwitz said the sand from the mining will be used for free stalls and has been in use for four to five years.

 

Chm. Penney called three times for any testimony in favor to the application.  There was none

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one letter from the Town Board of Matteson approving the application.

 

T. Murphy moved and D. Kussmann seconded the motion to GRANT the application for Conditional Use Permit.  The Town Board of Matteson was in favor of the application and there was no opposition presented at the hearing.   The following conditions MUST be met:  Provide the Zoning Office with a copy of the permit for the restoration from East Central Wisconsin Regional Planning Commission.  The Committee would like to review this Conditional Use Permit in five (5) years, which would be by March 22, 2017.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—

abstained and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:25 a.m.  The motion was carried.

The second public hearing was called to order at 10:26 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the notice as it appeared in the paper and the names of persons notified of the hearing for Todd & Sheila Zielke located in Sec. 26, Town of Little Wolf, Fire Number E6762, lying along Mountain Lake Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for the construction of a Single Family Residence in an AE (Agriculture Enterprise) District on approximately 7.734 acres.  The Committee and Jean Gliniecki made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Todd Zielke was sworn in to testify.  Mr. Zielke said I would like to build a home and start construction in April, 2012.  Mr. Zielke said he purchased the property in 2010.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one letter from the Little Wolf Town Board and Planning Commission of Little Wolf approving the application.

 

D. Kussmann moved and D. Federwitz  seconded the motion to GRANT the application for Conditional Use Permit. The Town of Little Wolf Planning Commission and the Town Board of Little Wolf were in favor of the application and there was no opposition presented at the hearing. The following conditions MUST be met:  Obtain a Sanitary Permit from the Zoning Office prior to the installation of a sanitary system on the property.  Obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the dwelling.  Obtain a Building Permit from the local Building Inspector prior to the construction of the dwelling.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:28 a.m.  The motion was carried.

 The third public hearing was called to order at 10:29 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the notice as it appeared in the paper and the names of persons notified of the hearing for Kenneth & Diane Winske located in Sec. 22, Town of Lind, Fire Number E3913, lying along Lind Center Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for the construction of a Single Family Residence in an AE (Agriculture Enterprise) District on approximately 40 acres. The Committee and Jean Gliniecki made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Ken Winske was sworn in to testify.  Mr. Winske said he would like to build a new home and remove the old home in one year.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

Deb Giuffre read two letters from the Town Board of Lind with conditions and Chairman of the Planning Commission Town of Lind approving the application.

 

D. Federwitz moved and R. Ellis seconded the motion to GRANT the application for Conditional Use Permit.  The Town Board of Lind was in favor of the application with conditions and there was no opposition presented at the hearing.  The following conditions MUST be met:  Meet the conditions of the Town Board of Lind. (See attached conditions).  Obtain a Sanitary Permit from the Zoning Office prior to the installation of a sanitary system on the property.  Obtain a Land Use Permit from the Planning & Zoning Office prior to the construction of the dwelling.  Obtain a Building Permit from the local Building Inspector prior to the construction of the dwelling.   Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:36 a.m.  The motion was carried.

The fourth public hearing was called to order at 10:37 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy, R. Ellis and D. Federwitz, all present.  Deb Giuffre read the notice as it appeared in the paper and the names of persons notified of the hearing for Steven A & Sue Ann Goedderz located in Sec. 31, Town of Lebanon, lying off of Stage Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Telecommunications Tower and Equipment Building in an RR (Rural Residential) District on approximately 10.56 acres.  The Committee and Jean Gliniecki made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Steve Goedderz was sworn in to testify.  Mr. Goedderz said he is the owner of the property where Element Mobile would like to erect a tower.

 

Jim Weinmann was sworn in to testify.  Mr. Weinmann said he is the contractor with Element Mobile. Mr. Weinmann discussed the proposed tower.  

 

John Steele was sworn in to testify.  Mr. Steele said he is an engineering representative for  Element Mobile.  Mr. Steele explained co-location and other tower locations.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application.

 

Wayne Poppy was sworn in to testify.  Mr. Poppy said he is the owner of Northport private airport. Mr. Poppy said that he has concerns with the tower's location with the runway and safety.

 

Jim Curns was sworn in to testify.  Mr. Curns said he is the Chairman for the Town of Mukwa and also a pilot.  Mr. Curns said that he also has concerns with the tower's location with the runway and also view obstruction.

 

Robert Harvey was sworn in to testify.  Mr. Harvey said that he is a pilot and is concerned with the clearance of the tower and safety.

Mark Ulrich was sworn in to testify.  Mr. Ulrich said he is a resident in the area and is opposed to the tower because there are other towers in the area that provide coverage.

 

Bill Kinzman was sworn in to testify.  Mr. Kinzman said that he is a pilot and President of Central County Airport.  Mr. Kinzman said he is concerned with safety regarding no lighting on the tower and that the FAA regulations do not apply to private airports.

 

Nicole Luetke was sworn in to testify.  Mrs. Luedtke said she lives ¼ of a mile from the proposed tower site and is concerned with possible health effects.  Mrs Luedtke said many area residents are in opposition and there are alternate sites.

 

Garrett Knoesptz was sworn in to testify.  Mr. Knoesptz said he is concerned with safety, property value and lack of lighting of the tower.

 

Brian Long was sworn in to testify.  Mr. Long said he is a pilot and a farmer in the area and is concerned with the safety with the airport.

 

Roger Cross was sworn in to testify.  Mr. Cross said that he has concerns regarding the airport and public safety.

 

Mary Green was sworn in to testify.  Mrs. Green said she lives in Mukwa ¼ mile from the tower on Tank Rd.  Mrs. Green said that the proposed tower should co-locate on the Tank Rd tower that it is lighted and well maintained.

Jim Wineman came back for rebuttal.  Mr. Wineman said he the private airport was not throughly discussed and the coordinates with the runway.  Mr. Wineman said he would check with the FAA rules that apply for a private airport for safety guidelines and rules. Mr. Wineman said that Element Mobile would agree to an aeronautic study.

 

Melinda Osterberg County Planner.  Mrs. Osterberg discussed possible options with the Committee as to the Bureau of Aeronautic study, third party review and the Town of Lebanon holding a meeting.   

 

D. Kussmann moved and D. Federwitz seconded the motion to CONTINUE the public hearing for the Conditional Use Permit due local pilots having concerns.  The Committee would like the applicant to have the Bureau of Aeronautics evaluate this tower proposal in relation to a private airstrip and render an opinion whether the proposed tower site presents an aviation hazard.  The Committee also suggested that the Town of Lebanon hold another meeting so that all the interested parties would be able to express their concerns to the Town Board of Lebanon. 

 

 Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; D. Federwitz—yes and T. Murphy—yes, unanimous vote to continue the permit.  D. Kussmann moved and D. Federwitz seconded the motion to close the hearing at 12:37 p.m.  The motion was carried.

 

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – March 22, 2012

 

REVIEW

 

Ø  Clarification on a decision for a Conditional Use Permit (CP-003-12) for George A. & Betty L. Shanak in Sec. 26, Town of Farmington.  R. Ellis moved and D. Kussmann seconded the motion to AMEND the condition to:  One (1) usable, licensed semi tractor trailer may be allowed on the property.  The motion was carried.

Ø  Conditional Use Permit (CP-015-11) for Natures Edge Ltd (Calvary Chapel Retreat Center). in Sec. 24, Town of Dayton and Sec. 19, Town of Lind concerning the number of camper sites.   R. Ellis moved and D. Kussmann seconded the motion to AMEND the condition to: The original proposal was for 9-10 camper sites and the Committee approved the request for additional camper sites not to exceed twenty (20) and the applicant MUST satisfy the sanitary requirements.  The motion was carried.

Ø  Corporation Counsel’s research on campground regulations.  The Committee decided to take a tour of a couple of campgrounds to view compliance with the ordinance.

Ø  Resolution to Adopt Public Participation Procedures to Amend the Waupaca County  Comprehensive Plan for the Preparation of a Revised Farmland Preservation Plan.  The Resolution to Adopt Public Participation Procedures will be discussed at next Committee meeting.

Ø  Conditional Use Permit (CP-012-87) for James Ohm in Sec. 16, Town of St. Lawrence for a recreational vehicle for temporary living purposes in excess of 30 days.  In order for the recreational vehicle to be relocated on the property, the Committee felt that another Conditional Use public hearing should be held.  With relocating the recreational vehicle, this would be an alteration to the existing Conditional Use Permit and the Committee was concerned with setting a precedent.

Ø  Conditional Use Permit (CP-005-02) for Dennis L. & Lois F. Pinno in Sec. 36, Town of Bear Creek for a five year review of a communication tower.  D. Kussmann moved and R. Ellis seconded to renew the permit for the communications tower for another five years and review it again at that time, which would be by March, 2017.  The motion was carried.

 

The next Planning and Zoning Committee meeting has been scheduled for April 12, 2012.
