MINUTES –February 9, 2012

 

 

 

ON-SITE INSPECTIONS:  The Committee made on-site inspections starting at 8:15 a.m. on the Lynn D. & Lisa J. MacDonald property, Town of Caledonia, Wayne Schwanke et al property, Town of Dayton, KBKTA LLC property, Town of Farmington and the George A. & Betty L. Shanak property, Town of Farmington.                                               

 

Chm. Penney called the meeting to order at: 10:00 a.m. with the following members present:  J. Penney, D. Kussmann, T. Murphy, and R. Ellis.  D. Federwitz was excused.

 

 R. Ellis moved and T. Murphy seconded the motion to approve the agenda as presented.  The motion was carried.

 

R. Ellis moved and T. Murphy seconded the motion to approve the minutes from the December 8, 2011 meeting.  The motion was carried.

 

PUBLIC HEARINGS:

 

The first public hearing was called to order at 10:04 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy and R. Ellis.  D. Federwitz was excused.   Deb Giuffre read the notice as it appeared in the paper and the names of persons notified of the hearing for Lynn D. & Lisa J. MacDonald located in part of the SE ¼ of the NW ¼ of Sec. 4, Town of Caledonia, Fire Number E8308, lying along Seefeld Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for the expansion and construction of a Substantial Residential Accessory Structure in an AWT (Agriculture Woodland Transition) District on approximately 5.6 acres.  The Committee and Jean Gliniecki made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Lynn MacDonald was sworn in to testify.  Mr. MacDonald said that he constructed a lean-to addition for personal storage use.  Mr. MacDonald said he decided not to follow the submitted drawing for another addition, and will build a free-standing smaller structure.

 

Chm. Penney called three times for any testimony in favor to the application. There was none.

 

Chm. Penney called three times for any testimony in opposition to the application. There was none.

 

Deb Giuffre read one letter from the Town Board of Caledonia and the Town of Caledonia Planning Commission approving the application.

 

D. Kussmann moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit.  The Town Board of Caledonia and the Town of Caledonia Planning Commission approved the application and there was no opposition presented at the hearing. The following conditions MUST be met: Obtain a Land Use Permit from the Planning & Zoning Office for the construction of the accessory structure.  Check to see if a Building Permit is necessary from the local Building Inspector for the

construction of the accessory structure. Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:14 a.m.  The motion was carried.

The second public hearing was called to order at 10:15 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy and R. Ellis.  D. Federwitz was excused.  Deb Giuffre read the notice as it appeared in the paper and the names of persons notified of the hearing for Wayne Schwanke et al located on Lots 1-5, 8-10 of Block D of Crystal River Subdivision and also being in part of the SW ¼ of the SE ¼ of Sec. 1, Town of Dayton, Fire Number E2341, lying along Danielson Road, Waupaca County, Wisconsin; for a Petition for Zoning Map Amendment from an AWT (Agriculture Woodland Transition) District to RC-N (Rural Commercial-Neighborhood) District for Indoor Sales and Service with a Conditional Use Permit Application for a Single Family Residence as an Accessory to a Principal Commercial Use and Long Term Outdoor Display and Sale for indoor/outdoor farm market on approximately 2.03 acres.  The Committee and Jean Gliniecki made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Eileen Schwanke was sworn in to testify.  Mrs. Schwanke said that she would like to open an antique, retail shop and farm market.  Mrs. Schwanke also discussed possible tube rental for tubing on the Crystal River, but would have to check the liability.

 

Chm. Penney called three times for any testimony in favor to the application. There was none

 

Chm. Penney called three times for any testimony in opposition to the application.

 

Robert Evan was sworn in to testify.  Mr. Evan said that he had concerns with the traffic and parking.

 

Deb Giuffre read one letter from the Town Board of Dayton approving the application.

 

Eileen Schwanke came back for rebuttal. Mrs. Schwanke said that customers could use the pasture for parking and currently there is parking for at least ten cars on the property.

 

R. Ellis moved and T. Murphy seconded the motion to GRANT the application for the Zoning Map Amendment.  The Dayton Planning Commission and the Town Board of Dayton approved this amendment.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes; and T. Murphy—yes, unanimous vote to grant the zone change.  The motion was carried.

 

R. Ellis moved and T. Murphy seconded the motion to GRANT the application for Conditional Use Permit.   The Town Board of Dayton approved the application. The following condition MUST be met:  Have the existing sanitary system evaluated to make sure that it is functioning properly.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 10:42 a.m.  The motion was carried.

The third public hearing was called to order at 10:43 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy and R. Ellis.  D. Federwitz was excused.   Deb Giuffre read the notice as it appeared in the paper and the names of persons notified of the hearing for KBKTA LLC located in part of the SE ¼ of the SE ¼  of Sec. 28, Town of Farmington, lying along Smith Lane, Waupaca County, Wisconsin; for a  Petition for Zoning Map Amendment from an PVRF (Private Recreation and Forestry) District to AWT (Agriculture and Woodland Transition) District to accommodate a boundary line adjustment between two adjoining parcels, one being in an PVRF (Private Recreation and Forestry) District and one being in an AWT (Agriculture and Woodland Transition) District on approximately .13 acres (5833 sq. ft.).   The Committee and Jean Gliniecki made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

Chris Korth was sworn in to testify.  Mr. Korth said that his driveway encroaches 20 feet on the adjoining property and that he would like to remove the encroachment, which requires a zone change.

 

Dale Trinrud was sworn in to testify.  Mr. Trinrud said he is the Chairman for the Town of Farmington and the Town of Farmington approved the application.

R. Ellis moved and D. Kussmann seconded the motion to GRANT the Petition for Zoning Map Amendment.  The Town Board of Farmington approved this amendment and there was no opposition presented at the hearing.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and T. Murphy—yes, unanimous vote to grant the zone change.  R. Ellis moved and D. Kussmann seconded the motion to close the hearing at 10:46 a.m.  The motion was carried.

The fourth public hearing was called to order at 10:48 a.m. by Chm. Penney.  Roll call was taken with the following members present:  J. Penney, D. Kussmann, T. Murphy and R. Ellis.  D. Federwitz was excused.  Deb Giuffre read the notice as it appeared in the paper and the names of persons notified of the hearing for George A. & Betty L. Shanak located in part of the NW ¼ of the NE ¼ of Sec. 26, Town of Farmington, lying along N. Westgate Acres Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for an addition to a Substantial Residential Accessory Structure in an RR (Rural Residential) District on approximately 5.097 acres.  The Committee and Jean Gliniecki made an on-site inspection of the property.  Vice-Chm. Kussmann read the general procedure and Chm. Penney declared it a legal hearing.

 

 

 

 

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – February 9, 2012

 

George Shanak was sworn in to testify.  Mr. Shanak said that he added a lean-to to an existing shed for firewood without a permit. He will clean up the property and remove the semi trailers and tractor by this summer.

 

R. Ellis asked if a business is operating there.

 

G. Shanak said no.

The following conditions MUST be met:  Obtain a Land Use Permit from the Planning & Zoning Office for the construction of the accessory structure.  Obtain a Building Permit if necessary from the local Building Inspector for the construction of the accessory structure.  Remove semi trailers and tractor by August 1, 2012.  Roll call vote was taken:  J. Penney—yes; D. Kussmann—yes; R. Ellis—yes and T. Murphy—yes, unanimous vote to grant the permit.  D. Kussmann moved and R. Ellis seconded the motion to close the hearing at 11:00 a.m.  The motion was carried.

REVIEW:

 

Ø  Waupaca County Farmland Preservation Plan Timeline:  The Wisconsin Department of Agriculture, Trade and Consumer Protection grant fund for the Farmland Preservation Plan is no longer available.  The Farmland Preservation Plan might be re-established by the end of 2013.  If the grant program is reinstated, it would be retroactive and Waupaca County could apply for funds.  The County should proceed with the Farmland Preservation Planning process

 

Ø  Proposed revisions to the Waupaca County Zoning Ordinance.  No new revisions in the proposed amendment to the Zoning Ordinance.

 

Ø  Review of the junkyards and campground regulations in Waupaca County.  The Committee reviewed the regulations for junkyards and campgrounds.  Jeff Henneman will send enforcement letters to the owners of the junkyards.  The Committee discussed revising the campground ordinance.  Corporation Counsel will check with other counties regarding their ordinances and will report at next Zoning Committee meeting.

 

 

WAUPACA COUNTY PLANNING & ZONING COMMITTEE MEETING MINUTES – February 9, 2012

 

 

Ø  New member appointments on the Implementation Steering Committee.  Craig Verkuilen, Jim Simpson, Kay Brockman-Mederas, Jerry Lyons and Monica Sperl will no longer be on the Committee but will be replaced by Steve Frings, Jane Haasch, Greg Blum, Art Richardson and Kay Ellis.  T. Murphy moved and D. Kussmann seconded the motion to approve new member appointments.  The motion was carried.

 

Ø  Conditional Use Permit (CP-2-07) for Richard C. & Grace L. Piechowski (Applicant – Cellcom) in Sec. 20, Town of Dayton for a five- year review of a telecommunications tower.  R. Ellis moved and T. Murphy seconded to renew the permit for another five years and review it again at that time, which would be by February, 2017.  The motion was carried.

 

Ø  Department policy change concerning meeting minutes.  The Committee wanted to review this policy after one year.  The Committee reviewed the policy and approved as is.

T. Murphy moved and D. Kussmann seconded the motion to adjourn the meeting at 12:15 p.m.  The motion was carried.
