          MEETING MINUTES

 

OPEN SESSION

 

1.                  Call Meeting To Order

 

Chair Dennis Kussman called the meeting to order at approximately 6:35 PM. 

 

2.                  Roll Call

 

Implementation Steering Committee Members Present:  Steve Frings (Town of Farmington), Art Richardson (Town of Lind), Jane Haasch (Town of Dayton), Terry Murphy (County Board), Stefan Shoup (Town of Wyoming), Kay Ellis (Town of Dayton), Patricia Craig (County Board), and Dennis Kussman (County Board)

 

Implementation Steering Committee Members Excused: Penny Leder (Town of Bear Creek), Jackie Beyer (Town of Little Wolf), Gary Marx (Town of Scandinavia), Michael Orr (Town of Waupaca), DuWayne Federwitz (County Board/Town of Matteson), Douglas Behnke (Town of Bear Creek), Michael Koles (University of Wisconsin-Extension), Marvin Schneider (Town of Caledonia), Greg Blum (Town of Iola)

 

Others Present:  Bob Ellis (County Board), John Penney (County Board), Jane Shoup (Town of Wyoming Resident), and Evan Abrahamson (Town of Waupaca)

3.                  Chair Kussman read the Open Meeting Statement, “This meeting and all other meetings of this committee are open to the public.  Proper notice has been posted and given to the press in accordance with Wisconsin Statutes, so the citizenry may be aware of the time, place and agenda of this meeting.”

 

4.                  Approve Agenda As Presented

 

Mr. Art Richardson motioned to approve the agenda as presented.  The motion was seconded by Ms. Jane Haasch.  Motion carried unanimously. 

 

5.                  Approve the Minutes from the April 25, 2012 ISC Meeting. 

 

Mr. Richardson motioned to approve the minutes from the April 25, 2012 ISC Meeting as presented.  Mr. Frings seconded the motion.  Motion carried unanimously. 

 

6.                  Continue Review of Proposed Changes to the Waupaca County Zoning Ordinance

 

The Committee continued their review on page 34 of the amended Zoning Ordinance.

 

Ms. Melinda Osterberg discussed having SP as a land use within the Permitted and Conditional Use Table.  The intent of the SP use is to indicate that a use is allowed, subject to review and approval of a site plan.  However, this has prevented the State viewing this as a commercial zoning district, as no uses are simply “permitted”.  The State’s interpretation of the SP use, is that it is not a permitted use and more similar to a conditional use.  This could pose problems in the future, particularly if lending institutions took the same view.

 

It was the agreement of the Committee to alter the table to have the SP uses be Permitted uses with a footnote indicating that they are subject to the site plan review standards set forth in Section 9 of the Zoning Ordinance.

 

The Committee corrected the numbering on page 38 of the Ordinance in section 6.06(1)(C)(5)(c)(3) should be 6.06(1)(C)(5)(d).

 

On page 61 of the Ordinance at the top of the page the Committee changed City to Town.

 

On page 63 of the Ordinance, under Large Solar Energy System, the Committee corrected primary to primarily in the first sentence of the definition.

 

On page 85 of the Ordinance, the Committee agreed to remove the requirement for owners of existing towers to register the Tower with the Zoning Administrator. 

 

Mr. Bob Ellis inquired if the million dollar liability insurance was standard on page 89 of the Ordinance.

 

Ms. Osterberg replied that she would do additional research and get back to him. 

 

The Committee discussed the definition of structural alteration and when it was necessary to get a land use permit.  Although structural alteration is defined within the Ordinance, there is some confusion as to when a land use permit is necessary.  The Committee agreed to check with Jeff Siewert and verify what definition should be included in the Ordinance.

 

Ms. Jean Gliniecki asked if the Committee could readdress the density provisions within the amended zoning ordinance. 

 

Mr. Jason Snyder indicated that the Office had considerable difficulty creating an automated density tracking system. 

 

Ms. Osterberg responded that this seems to be an administrative issue and that the Zoning Code, as amended, is consistent with the Waupaca County Comprehensive Plan.  Alterations to the density provisions within the Zoning Code could necessitate a comprehensive plan amendment and it would be best to have Mike Koles available for this discussion. 

 

 

7.                    Adjourn

 

It was the consensus of the Committee to schedule the next meeting for Wednesday, May 23, 2012 at 6:30.  At 8:35, Mr. Terry Murphy motioned to adjourn the meeting.  The motion was seconded by Mr. Richardson.  Motion carried unanimously.
