          MEETING MINUTES

 

OPEN SESSION

 

1.                  Call Meeting To Order

 

Chair Dennis Kussman called the meeting to order at approximately 7:00 PM. 

 

2.                  Roll Call

 

Implementation Steering Committee Members Present:  Mike Koles (University of Wisconsin-Extension), Michael Orr (Town of Waupaca), Patricia Craig (County Board), DuWayne Federwitz (County Board/Town of Matteson), Terry Murphy (County Board), Dennis Kussman (County Board), Stefan Shoup (Town of Wyoming), and Douglas Behnke (Town of Bear Creek).

 

Implementation Steering Committee Members Absent:   Jackie Beyer (Town of Little Wolf), Penny Leder (Town of Bear Creek), Jim Simpson (City of Clintonville)

 

Others Present:  John Penny (County Board), Kay Ellis (Town of Dayton Plan Commission), Bob Ellis (County Board), Jane Shoup (Town of Wyoming Resident), Helen Emslander (Town of Wyoming Resident), Jane Haasch (Town of Dayton Plan Commission). Art Richardson (Town of Lind)

3.                  Chair Kussman read the Open Meeting Statement, “This meeting and all other meetings of this committee are open to the public.  Proper notice has been posted and given to the press in accordance with Wisconsin Statutes, so the citizenry may be aware of the time, place and agenda of this meeting.”

 

4.                  Approve Agenda As Presented

 

DuWayne Federwitz motioned to approve the agenda as presented.  The motion was seconded by Bob Ellis.  Motion carried unanimously. 

 

5.                  Discuss Filling Committee Vacancies. 

 

The Committee discussed vacancies on the Implementation Steering Committee.  The Committee agreed to add Art Richardson from the Town of Lind and Jane Haasch from the Town of Dayton to the Committee.  The Committee discussed the need to fill other vacancies with someone familiar with zoning and planning issues while striving to have equal representation throughout the county. 

6.                  Discuss Tracking of Residential Development Right. 

 

Ms. Osterberg began the discussion of how to transfer development right and presented a current example of a boundary line adjustment necessitating the transfer of a development right.

 

Mr. Mike Koles explained that through the comprehensive planning process the intent was not to c create a transfer of development rights scheme, but rather to allow property owners the ability to cluster development.  Mr. Koles explained the concept of allowing a property owner with four development rights from four separate parcels the ability to use them to build four homes on a single parcel under their ownership. 

 

The Committee discussed the transfer of development rights across town boundaries.

 

Ms. Patricia Craig inquired if the Towns would have the ability to review and accept the transfer of development rights into their jurisdiction.

 

Mr. Koles replied that would be possible through the CSM review process and the ability of the jurisdiction receiving the density unit to review the proposed development could be written in the Subdivision Ordinance.

 

7.                  Continue Review of Proposed Changes to the Waupaca County Zoning Ordinance

 

Ms. Craig stated that the Committee had not resolved how to address Accessory Dwelling Units within the ordinance.  The Committee discussed the benefits of offering this land use and potential negative impacts.  The Committee determined that Accessory Dwelling Units could be Conditional Uses in rural zones, on parcels that cannot be further divided. 

 

Ms. Osterberg explained the proposed Administrative Conditional Use Permit process and stated that, pending State approval, this would allow for issuing permits for single family residences in Farmland Preservation zoning districts without holding a public hearing for each permit.

 

Ms. Osterberg stated that the Permitted Use Table includes the “Lot Clustering Density Bonus” and is also defined in Section 6, this was a use previously provided for within the Zoning Code but not included in the use table or definition section.  Ms. Osterberg also stated that the Bed and Breakfast land use was moved from the Commercial land use section to the Residential land use section reflecting where these uses typically occur.

 

8.                  Public Comments

 

Helen Emslander commented that Accessory Dwelling Units could serve as an Artist Retreat, which many communities would view as a positive and encouraged land use.

 

Kay Ellis stated that she agreed with Ms. Craig that an accessory dwelling unit would only accommodate a temporary situation and therefore shouldn’t be allowed within the zoning code.

 

 

 

 

 

9.                  Adjourn

 

It was the consensus of the Committee to schedule the next meeting for Wednesday February 8, 2012 at 6:30.  At 8:30, Michael Orr motioned to adjourn the meeting.  The motion was seconded by Stefan Shoup.  Motion carried unanimously.
