          MEETING MINUTES

 

OPEN SESSION

 

1.                  Call Meeting To Order

 

Chair Dennis Kussman called the meeting to order at approximately 6:30 PM. 

 

2.                  Roll Call

 

Implementation Steering Committee Members Present:  Patricia Craig (County Board), Art Richardson (Town of Lind), Mike Koles (University of Wisconsin-Extension), Michael Orr (Town of Waupaca), DuWayne Federwitz (County Board/Town of Matteson), Terry Murphy (County Board), Dennis Kussman (County Board), Stefan Shoup (Town of Wyoming), Jackie Beyer (Town of Little Wolf), Gary Marx (Town of Scandinavia), Steve Frings (Town of Farmington), Kay Ellis (Town of Dayton Plan Commission), and Douglas Behnke (Town of Bear Creek).

 

Implementation Steering Committee Members Excused:  Jane Haasch (Town of Dayton Plan Commission), Marvin Schneider (Town of Caledonia), Penny Leder (Town of Bear Creek), Greg Blum (Town of Iola)

Staff Present:  Melinda Osterberg, Jean Gliniecki, Jason Snyder, and Jeff Henneman

 

3.                  Chair Kussman read the Open Meeting Statement, “This meeting and all other meetings of this committee are open to the public.  Proper notice has been posted and given to the press in accordance with Wisconsin Statutes, so the citizenry may be aware of the time, place and agenda of this meeting.”

 

4.                  Approve Agenda As Presented

 

Doug Behnke motioned to approve the agenda as presented.  The motion was seconded by Jackie Beyer.  Motion carried unanimously. 

 

5.                  Continue Review of Proposed Changes to the Waupaca County Zoning Ordinance

 

County Planner Osterberg inquired if the Committee thought it was appropriate for the replacement of existing single family residences situated in the Agricultural Enterprise zoning district to go through the conditional use permit process. The Committee agreed that replacement of an existing residence should not necessitate the conditional use permit process.

 

Ms. Jackie Beyer, stated that it was unnecessary for existing legal lots of record, with a development right to go through the conditional use permit process for construction of a new single family residence.

 

Ms. Osterberg stated that this is a requirement of State Statute for farmland preservation zoning districts; however, the draft code contains a provision for an administrative conditional use permit process to be used in these situations. 

 

The Committee discussed the fee for an Administrative Conditional Use Permit and determined that $50.00 was the most appropriate charge.

 

The Committee discussed Community Living Arrangements and the districts where they should be allowed uses. The Committee agreed that Community Living Arrangements should be a permitted use within the AR, AWT, RR, SR-10, and SR-20 zoning districts.

 

The Committee discussed what structures should be exempt from obtaining a land use permit.  The Committee determined that structures less than 125 square feet in area should be exempt from obtaining a land use permit but would still have to meet all other applicable standards set forth within the Zoning Ordinance.

 

The Committee agreed that land use permits should lapse two years after issuance.

 

The Committee stated that Figure A-4 and associated description are confusing.  Ms. Osterberg stated that she would work on clarifying this in the next draft of the zoning ordinance. 

 

6.                  Begin Review of Proposed Changes to the Waupaca County Subdivision Ordinance.

 

The Committee agreed that the administrator of the Subdivision Ordinance should be the Planning and Zoning Office Staff rather than the “Planning Administrator.”

 

The Committee discussed requiring a survey for the sale or exchange of land between adjacent property owners.  The Committee decided to require a plat of survey for this type of exchange in order to help ensure clear title and the preparation of accurate legal descriptions.

 

7.                  Adjourn

 

It was the consensus of the Committee to schedule the next meeting for Thursday, March 22, 2012 at 6:30.  At 8:30, Jackie Beyer motioned to adjourn the meeting.  The motion was seconded by Gary Marx.  Motion carried unanimously.
