OPEN SESSION

 

1.                  Call Meeting To Order

 

Chair Dennis Kussmann called the meeting to order at 6:35 p.m. 

 

2.                  Roll Call

 

Implementation Steering Committee Members Present:  Penny Leder (Town of Bear Creek), Patricia Craig (County Board), Art Richardson (Town of Lind), Jane Haasch (Town of Dayton), Jackie Beyer (Town of Little Wolf), Stefan Shoup (Town of Wyoming), Gary Marx (Town of Scandinavia), Michael Orr (Town of Waupaca), DuWayne Federwitz (County Board/Town of Matteson), Steve Frings (Town of Farmington), Terry Murphy (County Board) and Dennis Kussmann (County Board).

 

Implementation Steering Committee Members Excused:  Douglas Behnke (Town of Bear Creek), Kay Ellis (Town of Dayton), Greg Blum (Town of Iola), Marvin Schneider (Town of Caledonia) and Michael Koles (University of Wisconsin-Extension).

 

Others Present:  John Penney (County Board).

 

Staff Present:  Ryan Brown, Jean Gliniecki, Jeff Henneman and Jason Snyder.

 

3.                  Chair Kussmann read the Open Meeting Statement, “This meeting and all other meetings of this committee are open to the public.  Proper notice has been posted and given to the press in accordance with Wisconsin Statutes, so the citizenry may be aware of the time, place and agenda of this meeting.”

 

4.                  Approve Agenda As Presented

 

Gary Marx motioned to approve the agenda as presented.  The motion was seconded by DuWayne Federwitz.  Motion carried unanimously. 

 

5.                  Approve the Minutes from the May 30, 2012 Implementation Steering Committee Meeting.

 

Pat Craig motioned to approve the minutes as presented.  The motion was seconded by Jackie Beyer.  Motion was carried unanimously.

 

6.                  Chm. Kussmann introduced the new Planning and Zoning Director, Ryan Brown, to the Committee.

 

7.                  The Committee reviewed the proposed amendments to the Waupaca County Zoning Ordinance that have developed since the last ISC meeting that was held on May 30, 2012.

 

Ø  Section 1.05.1 - Bear Creek and Matteson adopted dates were incorrect.  The Committee changed them.

Ø  Section 1.07 - Definitions of Lot, Lot Depth and Lot Width.  The Committee decided to use the same definitions that were used in the Subdivision Ordinance.

Ø  No definition of Zoning Administrator.  Not referenced in the Ordinances so the Committee decided to stay with Planning Director.

Ø  Section 2.02.5) - Concern regarding the word “new” in “... a permit for new construction,...)   The Committee suggested striking the word new.

Ø  Section 2.10)  - The reference to 6.11.6.c and d no longer makes sense as secondary farm residence was removed (to be discussed further)

Ø  Section 2.14.3.d - Reference is to 14.03.5.a – suggest simply 5.  Leave as is 14.03.5.a.

Ø  Table 5 April 25 minutes say Large Solar should be in PVRF, AE, AE-FP, AR and AWT. However, the May 30 minutes leave off PVRF. Should PVRF be included or not?  Also some question regarding whether or not AE-FP is okay.  This will be discussed at the next meeting.

Ø  Discuss that Substations (public service & utility) are okay in rural zones.  The Committee decided to allow Public Service & Utility in the PVRF (Private Recreation and Forestry) District and AWT (Agriculture and Woodland Transition) District as Conditional Use Permits.  (to be discussed further)

Ø  Section 6.06.1.b - Reference to COMM 27 is no longer correct, it should be SPS 327.  The Committee approved this change.

Ø  Section 6.06.4.b - Reference to 6.06.1.c.5 no longer works.  The Committee decided to take off the “5”.

Ø  Section 6.06.7 - Question regarding the reference to residential.  The Committee decided to leave the word “residential” in this section.

Ø  Section 6.06.12 - Concern that 101.91(10) refers to only manufactured homes/mobile homes. Shouldn’t reference also be made to stick built homes?  The Committee decided to take “or residence” out since this is referenced in another section of the ordinance. 

Ø  Section 6.11.6.d(2) - Reference 6.11.6.c and secondary farm residence is removed.  The Committee removed that reference.

Ø  Section 14.03.5.a (2) - Was removed  “Structural alterations involving ordinance maintenance” so the Committee took it out.

Ø  Section 14.03 - All references are to Planning Director.  The Committee decided to leave it in.

Ø  Section 14.03.5.c (1) - References to deputies removed, was leftover from Town Zoning Deputies, which no longer exist.  The Committee took it out.

Ø  Section 14.05(5) - Is incomplete, either take it out or complete it.  The Committee took it out and it should be renumbered.

Ø  Typos were corrected on page 25 under “Community Living Facility – 0 to 15, should be “9” to 15.  Page 36 in Sec. 6.06.14.f, instead of residential unit “it” permitted, it should be “is” permitted.  Page 57 in Sec. 6.11.6.d.3, instead of “employees”, it should be “employs”. Page 77 in Sec. 11.07.1.i, instead of “r own”, it should be “or owner”.  Page 85 in Sec. 14.03.5.a.4, should take out the letter “r”.  Page 86 in Sec. 14.03.5.c.1, should take out the letter “s”.  Page 91 in Sec. 14.03.5.c.9.b, instead of “Trace”, it should be “Trade”.

Ø  The Committee decided that the definition of the word “lot” should be added to the Zoning Ordinance and use the same definition as what is listed in the Subdivision Ordinance. 

 

The Committee reviewed the proposed amendments to the Waupaca County Subdivision Ordinance that have developed since the last ISC meeting that was held on May 30, 2012.

 

Ø  Section 2.02 under Definitions, the Committee decided to add the ordinance chapter numbers to the Sanitary and Zoning Ordinance definitions. Also, the definitions illustrates that they refer to the County Ordinances, so the Committee decided to remove the word “County” from the titles and then reorder/renumber them.

Ø  The definition of “Building” references “Structure”. The Committee decided to add the definition of Structure from the Zoning Ordinance.  There was discussion on whether or not some of the items that were listed as structures would need to obtain Land Use Permits.  The Committee decided to add some of these structures such as above ground storage tanks, seasonal above ground swimming pools, hot tubs and spas as Exemptions.

Ø  The Committee added the definition of “Contiguous” from the Zoning Ordinance into the Subdivision Ordinance.

Ø  The Committee decided to use the definitions of “Lot”, “Lot Depth” and “Lot Width” from the Subdivision Ordinance also in the Zoning Ordinance to make them consistent.

Ø  The Committee chose the following definition for “Remnant” to be added to the Subdivision Ordinance:  “Remnant:  The portion of land remaining after the division of a larger parcel.” 

Also to delete the word “remnant” out of the following definitions:

Certified Survey Map:  A map, prepared in accordance with Section 236.34 of the Wisconsin Statutes and this Ordinance, for the purpose of dividing land into not more than four parcels, inclusive of the remnant parent parcel, or used to document for recording purposes survey and dedication data relating to single parcels.

 Outlot:  “A remnant parcel of land not to be used for building purposes, so designated on the Plat or Certified Survey Map which is any of the following:...”

Ø  The Committee added a definition for “Shoreland Ordinance,” since there is one for Zoning and Sanitary.

Ø  Section 3.09 Penalties – With the recommendation from Jeff Siewert, Corporation Counsel, the Committee decided to remove the portion that states “and in default of payment of such forfeiture and costs shall be imprisoned in the County Jail until payment thereof for a period not to exceed six months.”

Ø  The statement “Section 8.07.3(a) and (b) shall only apply to land divisions creating three or more lots” got lost in the section, so the Committee decided to place it in Section 8.07.3.

Ø  Section 12 - Refers to paying a fee to the County Treasurer, so the Committee changed that to “pay a fee to the Planning & Zoning Office”.
