Waupaca County Finance and Human Resource Committee

Minutes – July 15, 2014

 

Chr. Federwitz called the meeting to order at 11:30 a.m. and gave the opening meeting statement; this agenda has been properly noticed. 

 

Roll Call:  Chr. Federwitz, Suprs. Barrington-excused, Craig, Flease, G. Murphy, Penney, Neumann and Co. Bd. Chr. Koeppen-excused, a quorum has been established.  Others present:  Ryan Brown, Mary Robbins and Jeff Siewert.

 

Review and Approve Agenda.  Motion:  Supr. Craig moved and Supr. Neumann seconded the motion to approve the agenda.

 

Public Comment. – Atty. Thomas Maroney appeared before the committee.  Atty. Maroney explained that he represents Archie & Margaret Overby concerning property located in Sec. 3, Town of Dayton.  Atty. Maroney stated that they felt this was not a typical Board of Adjustment variance but a modification to  an existing variance, from 1984.  No one testified against the modification of the variance, the modification would be to remove the stipulation that no kitchen facilities may be located in the second dwelling.  The modification was approved 3 to 2 by the Board of Adjustment Hearing held on June 12, 2014.

 

Chr. Federwitz stated that a motion to consider rescinding action previously taken on July 9, 2014 related to item No. 7 on the Finance/HR Committee agenda.  Motion:  Supr. G. Murphy moved and Supr. Neumann seconded the motion to rescind the previous decision due to the posting requirements and open it up for reconsideration.  The motion was carried with Supr. Craig abstaining.

 

Ryan Brown, Planning & Zoning Director explained to the committee that this extra dwelling unit is against the Waupaca County Zoning and Shoreland Ordinance and would like to pursue an appeal using funding from the Planning & Zoning Department budget of approximately $15,000.00.

 

 Appeal to Board of Adjustment Decision - Motion:  Supr. G. Murphy moved and Supr. Penney seconded the motion to authorize using funding from the Planning & Zoning Dept. Salvage Yard Fund to hire an outside Attorney for the appeal to Circuit Court of the June 12, 2014 Board of Adjustment decision for the variance in Sec. 3, Town of Dayton, not to exceed $15,000.00.  Roll call vote:  Chr. Federwitz—yes, Barrington—excused, Flease—no; Supr. G. Murphy—yes; Supr. Penney—yes; Supr. Neumann—yes and Co. Bd. Chr. Koeppen-absent and Supr. Craig abstaining from the vote.  The motion carried with 4 yes, 1 no vote; 2 absent and 1 abstention.

 

Adjourn.  Motion:  Supr. Flease moved and Supr. Federwitz seconded the motion to adjourn the meeting at 11:55 a.m.
