WAUPACA COUNTY BOARD OF ADJUSTMENT MEETING

MINUTES –JANUARY 30, 2014

 

Chm. Loughrin called the meeting to order at 9:07 a.m.  Roll call was taken with the following members present:  J. Fulcher, J. Beyer, D. Johnson, R. Hoffmann, J. Loughrin and P. Craig, present.  L. Mares, excused. 

 

J. Fulcher moved and D. Johnson seconded the motion to approve the agenda as presented.  The motion was carried.

 

P. Craig moved and J. Beyer seconded the motion to approve the minutes from the December 5, 2013 meeting.  The motion was carried.

 

PUBLIC MEETING:

 

A procedural meeting was held by the Waupaca County Board of Adjustment to discuss hearing procedures and establish hearing parameters concerning an Appeal to a Planning & Zoning Committee decision that was made on June 6, 2013 for the following:  Gerald A. & Susan M. Tellock and Roger E. & Geraldine Henschel, located in the SE ¼ of Sec. 13, Town of Union, lying along Dennison Road, Waupaca County, Wisconsin; for a Conditional Use Permit application for a Non-Metallic Mineral Extraction in an AE (Agriculture Enterprise) District on approximately 160 acres. 

 

 Attorney Ronald Stadler is the representative for the Waupaca County Board of Adjustment and discussed the timeline for the hearing information to be disbursed, Board of Adjustment review of briefs and the scope of the public hearing, and the public hearing for the Appeal to the Board of Adjustment.

 

Attorney Thomas Moniz is the representative for Gerald A. & Susan M. Tellock, Roger E. & Geraldine Henschel and A.F. Gelhar Co., Inc.   

 

Attorney Brian Hamill is the representative for the residents of the Town of Union who reside near the proposed site.  

 

Jean Gliniecki, Zoning Administrator, conferred with Attorney Ronald Stadler regarding the timeline for the briefs and the public hearing for the Appeal to the Board of Adjustment. 

 

Thursday, December 5, 2013 @ 8:15 a.m. – The Board conducted an on-site inspection of the Sand Mine site, Town of Union.

 

Friday, April 4, 2014 – Deadline to receive Appellant to file Prehearing brief; Responses due by April 11, 2014; Appellants’ reply due April 18, 2014.

 

Thursday, May 1, 2014 @ 9:00 a.m. and to go no later than 4:00 p.m. – Board of Adjustment will review briefs and define the scope of the public hearing. 

·         The Board will convene in closed session pursuant to Wis. Stats. §§19.85 (1) (a) and (g) to deliberate concerning a case which is the subject of a judicial or quasi-judicial trial or hearing before that governmental body and to confer with legal counsel for who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved.  The scope of this meeting will be to address the parties’ arguments on the standard of review.

 

·         The Board may reconvene into open session to render its opinion.

 

Thursday, May 15, 2014 @ 9:00 a.m. and to go no later than 4:00 p.m. – Public hearing for the Appeal to the Board of Adjustment.

 

 

 

Friday, May 16, 2014 @ 9:00 a.m. and to go no later than 4:00 p.m. – If necessary to continue with the public hearing.

 

 

 

Monday, May 19, 2014 @ 9:00 a.m. and to go no later than 4:00 p.m – If necessary for the Board of Adjustment to begin or complete its deliberations.

 

 

 

 

J. Beyer moved and D. Johnson seconded the motion to adjourn the meeting at 9:30 a.m.  The motion was carried.  The Board adjourned.

 

The Board of Adjustment and the Attorneys received the full record from all the meetings, information received, etc. that the Planning and Zoning Committee had attended and received.
